I was not replying to you, however, the definition of assault you provided, "intentionally putting another person in reasonable apprehension of an imminent harmful or offensive contact" does not apply in the least to the event shown on the video in question, not by a long shot. The guy swung at the megaphone, not at the dude holding the megaphone so, no assault and no " reasonable apprehension of an imminent harmful or offensive contact". This is getting tiresome.
