When my crappy retail job started asking back in May I told them I don't share my medical information. They accepted that. But............ promptly shortened my already short hours, attempted to change my shift, and left me, a senior citizen (almost) alone to do work requiring heavy lifting.... so I quit a few months later. All of those so quick to say don't quit - make them fire you, you often don't know what you are talking about. That particular crappy job wasn't worth the harrassment.
Working a crappy part-time job is not worth harassment for sure. But if you've been working for a company, full-time, for the past 10+ years, then make them fire you.
I think he's just trying to prep us for any legal balls and why we might not win this particular one.
.
.
However u can sue the shit put of them if they ask more questions such as "WHY are you not vaccinated" or "What is your religion" or "I got it, so u need to get it too." Or if they don't store your responses securely.
Just ask, “if I get the vaccine because you’re making me and I have an adverse reaction where I’m in the hospital, will our company compensate me for that?”
That's what I did, basically. I am banished to only work remotely until I share vax papers... so forever. I've been given less high profile work but idgaf
My status deadline is tomorrow. I am using the 4th and 5th in my refusal.
The 4th, which protects my private property. And that includes my body.
The 5th requires that my accusers (who I am supposed to be able to face) prove my guilt (i.e., dangerously infected); can't make me incriminate myself; and can't deny me of life, liberty or property without due process.
But constitutional defenses, which should be a slam dunk aren't getting much traction. At least when applied by Attorneys. I am making this defense using the Common Law. I just made this extensive post about my fight this morning. Should be some help for you.
Just declare an exemption based on Title VII of the Civil Rights Act of 1964. That should shut them up. Or, probably better if you don't mind getting fired, just tell them to simply "No".
No. The 5th amendment is a protection against a criminal inquiry. Your employer can ask you whatever they want. And fire you when you don't answer, except in circumstances where a contract exists stating otherwise.

My legal argument to employers and government is complicated, but see if you can follow: "It's none of your fucking business."
That's a good reply. Just like I tell people "my pronouns are fuck/off".
LOL, mind if I steal that?

This. I want to know what they say when someone looks them straight in the eye and asks them this
Just say HIPAA violation

They will not ask. They simply demand that you show proof of compliance.

5th amendment applies to whether the government can compel you to incriminate yourself.
Not a thing

File a medical or religious exemption. What state??
"It's none of your business" is the only answer you need. Do not comply in any degree. Ride it out if you have to.
