The government argued this earlier, but this wasn't part of the 6th Circuit decision. The initial 3 person panel of judges ruled to end the 5th Circuit Stay and the decision for an en banc court ruling was evenly split. This means it has to go to SCOTUS.
We need to get a class action lawsuit going against OSHA. to my understanding they have to show that covid is a grave danger to the workplace in order to do anything. How in the fuck can it be a grave danger?

Even if OSHA can’t force private companies to do anything, that doesn’t mean employers aren’t doing it themselves.
I understand people are trying to be optimistic, but if SCOTUS doesn’t issue a stay, there’s going to be a lot of unemployed people come January 4th.

I think the Federal OSHA only has jurisdiction over Federal employees, Washington D.C. and maybe the territories (Puerto Rico e.g.).
