So correct me if I'm wrong, but because of the EPA vs West Virginia ruling, all the ATF Shenanigans are now null and void correct?
🏆 - WINNING - 🏆
So this means their stupid 80% rule, forced reset trigger rule, their upcoming pistol brace rule, etc. etc. etc. are all now null and void correct? In other words, ALL of the freaking gun control that the ATF created out of thin air without proper authority is no longer enforceable.
They are only null and void if you sue the government citing the precedents of this case.
This decision does nothing proactively. We have to use it reactively to bite back.
The Alphabet Agencies are safe, for now, but their armor has been taken off, which means they are gonna be extra careful not to end up in another case like this.
I get what you're saying, but thinking about all of the lawsuits already in the pipeline, it seems to me this may result in them backtracking quite a bit since, as you said, they no longer have their armor.
They will pull back their forces, this is true and good.
They lost the shield, but they still have the sword.
However, when you both lose your shield and have your back against the wall, that's typically when you start swinging for the fences. If you stop attacking, even for a moment, it gives the opposition opportunity to strike a decisive blow.
The DeepState will be extra cautious, and then suddenly, when they feel threatened, they'll start swinging at everything that moves with gross misuses of power.
That's when Jim Jones gives the order to bring out the koolaide, cyanide and needles.
I think they've already started the gross misuses of power part.
Could a lower court put injunctions on certain agency mandates citing this new precedent? My fear is that every challenge to the agencies' power over reach will take years to dismantle.
You have to bring it to court.
The Government can actually do ANYTHING they want.
They can send officials to bash down your door, pour gasoline on every possession you own, light the match, drag you out, snap your legs, throw you in a dumpster and push you off a cliff.
They can do all these things, for any reason. For "Climate Change" if they want. If you resist, they'll shoot you for resisting.
They can DO anything they want because we gave them authority to ACT. This is why they can arrest you without finding you guilty of a crime.
The only place they face consequence is in the Court. Not until you challenge the government and have a Court decide that the Government was WRONG to do all those things to you, will you get justice and remedy.
Once a Court finds they cannot do these things, then lower Courts can settle the matter and award appropriate remedies almost immediately. That's why SCOTUS cases are important. It's so we don't have to wait another 5+ years -- it can be settled in the lower Courts which simply have to cite this precedent.
So, yes. Lower courts can now make decisions, but only if we bring cases. We won't have to wait 5+ years like we did for this case, but we will still have to wait a year or two for the lower Courts to process it all. It sucks, but that's the only way the People can get justice outside of Mob rule.
Appreciate you taking the time. Makes sense. So it's definitely a win but the ripple effect will take a little while.
Maybe 18 USC 241, 242 can help ....
Especially 242: while enjoying a right ....
There are purportedly lawsuits already filed regarding the ATFs new rules. Also recall the FDA was thwarted regarding Juuls vaporized cigs. A federal court on Friday granted a request by Juul Labs to temporarily block an order by the Food and Drug Administration to stop selling its electronic cigarettes in the U.S. I'm not an e-cig fan so I don't have a stake in this, but I do look at trends. It appears to be momentum for State department agencies to be neutered. I hope it continues especially in the arena of firearms and vaxxxination.
Just as I wrote this, SCOTUS overturned the Stay-in-Mexico Trump policy and sided with Biden. Momentum? Maybe not. A country is defined by it's strong borders. To allow every people 'asylum' for concocted reasons of persecution is not just insane, it is not recognizing they really come here to get on SSA welfare. We see the same pattern of movements of people in the US leaving their city to move to another State in which their policy is easier to qualify for welfare benefits.
If this is the case, then there is misinformation in the fake news. Remanding or sending a case back to the lower court usually is for clarification and elimination of ambiguity in the original ruling. I don't know the specifics, but it sounds like SCOTUS is asking the lower court to clarify their ruling.
Dude.
I agree but the [DS] will take it to the mat. Lawsuits will be required.
What about oil shutdowns such as Keystone pipeline.
I would presume that this would make it a bigger headache for the EPA to keep their stranglehold on the oil companies, if the oil companies were willing to take them to court.
Specifically, Joe Biden signed Executive Order 13990, which terminated many of Trump's executive orders that directed the EPA to use much looser regulations pertaining to energy, oil, and infrastructure projects. These included EOs 13868, 13807, 13795, 13783, etc
Those Trump EOs basically told the EPA to stop killing our ability to drill for oil, frack, mine coal etc. When Biden signed his EO nullifying Trump's series of orders, he did so with the assumption that the EPA held the power to regulate with an iron fist. Now, the SC decision has put that in jeopardy, and the EPA may have to loosen their regulations up or face litigation by companies wanting to drill.
From what I understand, the Supreme Court stopped a federal agency from enforcing rules it made up instead of enforcing laws passed by Congress. All the federal agencies have shit tons of these rules (You know I've been on this board too long when I use words like "shit tons.") The federal agencies might easily keep using their made-up rules until they get stopped by a court, but they might be a little hesitant to make up new ones.
On a grander scale, we may have the 10th amendment coming into play with a MAGA Congress. Actually enforcing the 10th amendment means eliminating most of the federal government. Only the specific functions of the federal government outlined in the Constitution are legal at all, which has, of course, been ignored up to now. The MAGA Congress will not ignore this.
And a MAGA Congress can use this Supreme Court decision to shut down all parts of legal federal agencies that use rules that were not specifically passed by Congress. Plus fix the stupid ones that were.
Deep State is seriously Nadlering about all this. It WILL shut them down.
Every one of these agency groups believes they can edit the definition of anything they like, and then laws come into being purely based on any new definition they dream up. Which they dont have to justify in any way, or be accountable for since none of them are elected. We have seen this definition-creep by the 'everything is considered to be a gun', etc assertions by ATF, but they all do it. Laws exist only with the understanding of the words that constitute the bill having the meaning they do at the time the bill was passed into law. Otherwise dictionary companies could pretend to be legislative bodies as well.
So they insist they have legislative authority without it ever having been delegated to them, or recognized as such in any way. Thats the crux here, is my understanding. And it took the SC judgement to say No.
Did this ruling just rule that the amendment by the ORIGINAL Congress make any and ALL later Congressional laws about guns and gun control - Null & Void?
"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."
Until the 1984 decision " Chevron v. Natural Resources Defense Council" gets corrected federal agencies will continue to act stupid and get away with it.
