This is great news. Say goodbye to "we have to pass it to find out what's in it!" I really think we have the numbers on this one. I know that Scalia could be a good conservative on some issues, but he was arguably pro-Chevron, and Gorsuch is decidedly not.
There was a time when congress wrote their own legislation decades ago. Now it's all farmed out to these massive firms tied to lobbyists.
Think positively. The first ducks on the line at the fair should be the ATF & DHS. Then the EPA, Dept of Ed, CDC, FDA, FEMA, BLM, HHS, CIA, & THE UN.
You missed the IRS, but I get the magnitude of the problem. Plus we need to exit the WHO.
Why ATF first? Completely understand and agree about DHS as first. I think I’d put UN first myself.
By allowing pistol braces to be labeled as illegal unless registered or destroyed, they're trying to make millions of Americans into felons overnight by the end of this month.
No weapons should be illegal. There is no reason I shouldn't be allowed to own a cannon like our forefathers or a cruise missile if I can afford it. It's insane they can pick and choose what weapons they think we can have. The 2nd amendment is clear, our rights shall not be infringed, it doesn't say our rights shall only be infringed if they government thinks a weapon is too dangerous.
right, it's there in black and white, "shall not infringe"
Because protecting our 2nd amendment is that important!!
Let’s not forget the IRS.

Was holding out on the IRS until my refund deposited & was able to transfer it to an unlinked acct. Can now say phuqem 2!!!
If successful, will this challenge destroy the power of the Senior Executive Service?
That would be sweet.
I'd have to look into that. Off the top of my head it would limit the damage they could do for sure.
Like the CDC being allowed to dictate what people can and can not do? I've been telling people that the CDC is NOT a legislative body! They can't make laws or tell you what to do. Their only job is to make "recommendations". Yet the MSM makes them out to be lawmakers. Kind of the same way they make the Federal Reserve out to be part of the Federal Government.
In my mind I always think the Republic is like a great machine that has been worn down by the elements. Like a beautiful car that is all rusted over time and needs a rebuild. The rust in this case is the human condition. They have eroded the separation of powers and the general Constitutional framework with death by a thousand cuts. The federal government was never ever supposed to be this big. Congress was never supposed to delegate its lawmaking to the executive branch. We were never supposed to be slaves to a tax system, etc. If you always have to pay a "property tax" how do you ever really own the land you live on? My parents paid off their mortgage in 10 years. For what? My widowed mother's property taxes are 10 times what her mortgage payment was years ago. They could have refinanced forever and it wouldn't have made a difference. She's still dependent on the federal government for her survival.
It was incremental and as anticipated by the founders, on an approximate 200 year time frame. Just like you can predict the average life of a car, a Republic can only last so long until the human condition wears it down. The founders really were political "scientists." They James Madison was probably my favorite. He was such a genius at such a young age. Time for a rebuild that's for sure. We have to tear this thing apart, take of the rust and corrosion, and put it back together all shiny and new.
No more bondo, it's a frame up restoration of the Republic and we're the mechanics.
Boom
I had to look it up.
The Chevron Deference, established in 1984, basically says that if the law empowering an agency doesn't explicitly say not to do something to meet the goals of the statute, the agency can do it.
In a nutshell, what happens is Congress makes a law that says "the Secretary shall implement rules". The Secretary will be defined as. for example, the HHS Secretary (remember Kathleen Sebelius?") Then, in addition to a 2000 page law like Obamacare, you have 40,000 pages of implementing "Regulations." The Regulations cannot conflict with the plain language of the statute, but otherwise it's a free for all and executive branch bureaucrats like Sebelius are free to draft any regulation they want, which are really just laws by another name. This is an in your face violation of Article II of the Constitution which specifically says Congress has the exclusive right and duty to "make law." The separation of powers depends on adhering to these delegated roles obviously. We don't elect people like Sebelius and we can't get rid of people like her. Okay, rant over. Has always driven me crazy. Calling them "rules" doesn't change the fact that they are effectively laws. Congress passes the buck to avoid accountability and then people like Pelosi say things like "We have to pass. it first to find out what's in it!" That is Chevron in a nutshell. It NEEDS to be overturned.
The regime's "laws" are not worth the toilet paper they were written on. Buh bye smd
Timely, Mr Gorsuch, Timely.
Otherwise known as k street, wash, dc
Is this the Brunson case?
No different issue. But Gorsuch has written opinions before becoming SC judge, very critical of the decades old Chevron decision which exploded the bureaucratic state. I think it will be overturned.
Thank you!
Good luck enforcing it?
it doesn't sound like it. this is challenging the constitutionality of the unelected agencies granted power to do the job that was given to congress. one example is the department of education...
and the EPA
And the ATF.
GC
Yeah...They lost against WV not too long ago, eh?
Thank you!
Whenever a congress critter says something like "I helped push such&such a law through", just remember all the laws passed through legislation are written by corporate lawyers at the request of that corporation and then marketed to our elected lawmakers.
They often don't even read it before sponsoring it. Corporations are running the country at this point.
I don't think this will end well. I think the SC is DS
