Who grants the mistrial, the judge?
Don't quote me, but imagine if the cause for a mistrial is the judge, then the next higher court decides it. I believe this is not criminal court, its civil, so i think criminal court judge would decide

This is why I think they chose a different route.
Do not understand...why wait. It is obvious the entire thing is a sham. And a judge involved in this sham is probably going to deny. So next appeals court?
Timing
I don't think this is going to happen.
They initially said they were filing this last week.
The did ask the judge for a directed verdict.....which is saying the state didn't prove their case, so there's no need for the defense to go on. The Judge said the trial would continue today and it did.
They they claimed they were going to finally for mistrial immediately, but they didn't.
But they did do something else.
Elise Stefanik filed a an Ethics complaint to the New York State Commission on Judicial Conduct.

Doesn't that mean he can be tried again for the same (supposed) crime?
I know they can't try him again if he's found not-guilty. That's double jeopardy, though I think it's more complicated than that.
