Can someone explain to me how someone who illegally enters the country can get "due process"? I always thought our Constitution was for OUR legal citizens!
Perhaps this is the test for the Bill of Rights and their application. Rand Paul is not wrong that the wording in the Bill of Rights states "the people" or *persons," not citizens. Therefore, maybe the courts could rule on behalf of illegal immigrants, then it could be elevated to SCOTUS.
The larger perspective is that these are amendments to the Constitution written by "We, the people." Logically, the people referred to in the amendments would be those who are "of the United States."
Hm. Since it is the States which hold primary duties, would it not be the States which would need to declare which are its citizens?
Also I can guarantee 500000000% accuracy that the founding fathers, for example, didn't write the second amendment to protect foreign invaders rights to have a gun in America.
I vote for a speedy trial. Meaning- Put the judge on the plane with them back to their home country. If by the time the get there they are found innocent, they can fly back.

A condition of any visa anywhere in the world is that it must be presented in a timely manner upon request. These people didn't do that, meaning even if they had a visa, they violated the terms of it. That was step 1 in their due process. The next step in due process is deportation. So due process, sure. But that doesn't include a judge unless you are legally in the country.
What the liberals want is for the corrupt immigration judges to make the decisions. And since there is a 2 year backlog for an immigration judge, nothing will happen.
This process is not subject to judicial review, but the liberals want to make it be that way.

If they report to the embassy with the proper credentials, of a legal right to return .

Due process is a matter of viewpoint. The clause is related to citizens, and prescribed.
Those who are not citizens, are in the country based on contract, establishing the due part. Violate the contract => removal.
Those who have violated the law, and yet are on US soil .... have their due process, by finding and removal ....
