This really is an excellent idea and should be seriously looked at.
I would say if over 5 percent of their cases are overturned or some other percent that those knowledgeable on the court system comes up with.... the reason not a fixed number is that judge that sees 2,000 cases and get 5 cases overturned is better than a judge who see 300 cases and get 3 overturned. I still want judges who question previous rulings of the court, but I want them to temper the disagreement

I’ve been screaming this for years - there’s literally zero repercussions for a judge to do what judges have been doing.
I want to go a bit further:
if a sitting judge is overturned by a higher court more than 3 times, they should be ineligible to continue being both a judge and an attorney (bar card gets pulled), because they obviously do not know the Constitution or are purposely ignoring it.
if a judges ruling is overturned, and that bad judgement resulted in some loss of rights for an individual, the judge is removed from the bench immediately. (Eg, do not EVER incorrectly rule against a member of We The People or you’re toast).
Members of Congress that vote for a bill that is later overturned as Unconstitutional must be dealt with as well.
Public servants should be scared to death of being impeached and removed should anything they do ever be deemed Unconstitutional. Egregious violations (such as federal judges making rulings in direct violation of SCOTUS as they are now) deserve real prison time.
Make tarring and feathering politicians and judges great again!
When I ran for Congress , I put in my platform, that the work and decisions of every federal judge be reviewed by Congress and a straight vote is taken on whether they keep their job or not. The GOP asked me to take that off my campaign website. Since they weren’t helping with funding, I told them to shove it.
Can we make that retroactive to 2020?

I've been saying this for years. These judged know their rulings will be overturned. It's just a tactic to delay, cause problems, and het their name in the news. They should also have to repay any court costs involved in having their ruling overturned.
If they get opinions overturned they should be liable as they did not apply the law correctly. Which is judicial malfeasance. Civil suits could go a long way to get this back in check.

This assumes that higher courts will rule more accurately and ethically than lower courts.
What if a higher court is controlled by a leftist judge, and they maliciously overturn a lower court’s conservative rulings often enough to achieve whatever threshold is established as the standard?
Does that lower conservative judge then get fired?
I was waiting for someone to bring that up. The answer is elections, particularly honest elections, mean things. These are two things that need to be fixed.
Judicial review was not in the Constitution, it was Marberry v Madison 1803 that judges gave judges the power of review. Nix that.

They should be fired and banned from every court in the US. The problem is with 'opinions'. If they are getting overturned they are not based on The Law.
Nope. Overturned more than once. That's it. 3 times given the slow wheel of the judicial system. That could be years of a judge getting it "right" and then just retire and drag out years of political gamesmanship. Way too easy for anyone to game this current suggestion. Significant accountability and culpability needs to be in place. What happened to judges are intended to be unbiased and unopinionated. Opinion and judge do not belong in the same sentence.

Yeah, I say the same thing about presidents, or in this case residents, (the Biden) 3 strikes your out, when it comes to constitutional violations.
Just remove these marxist judges from the bench permanently, deport any that are not citizens and revoke their licenses to practice law.
White Hats dilemma is that some judges are selected by the sitting president and once he/she is corrupt you understand what you'll get! Activist judges is just a nice way of saying corrupt judges!
We need a congress with a spine that knows the constitution. And remembers what impeachment is for.
