Im thinking this being unprecedented, congress has to pass something to bring it to court, which would then send it back to congress to certify. But it sucks there happens to be a government shutdown that prevents this dilemma to go past one branch of government. Funny how it worked out.

Depends, I guess.
It seems to me that it was an open secret inside the White House that Biden was not competent to make decisions.
Which means that the autopen was used without his permission/authority.
That's fraud, and fraud vitiates everything.

Nothing is stopping Congress from voting on other issues. The house has decided to take an extended vacation.
It should be a high hurdle. But it may bring clarity for future issues.
