JUST IN: Antifa Members Convicted of Terrorism Charges Sentenced to 50 to 100 Years in Prison for Attack on Texas ICE Detention ...
Eight of the ten Antifa members convicted of terrorism charges for an attack on a Texas ICE detention center were sentenced to at least 50 years in prison on…
I wonder what their ages are. They look young now, but when they come out of jail the best parts of their lives will be over and they will have to get a job so they can survive. Oh well, they fought the law and the law won.
I hope this sends a huge message to others of their ilk. By committing Federal crimes they graduated to the big leagues. Not permissive State and local crimes where it's a slap on the wrist and a revolving door.
It will drive Antifa further underground however. Now that they are a designated terror group they will disband and rebrand for cover. But at least the message is being sent that under this administration, don't mess with the Feds and don't mess with Texas.
This is a Federal prison sentence, so no early parole for good behavior.
It can be appealed, but typically because of legal errors or sentencing mistakes that exceed the statutory limits.
A federal sentence can be appealed on the grounds that it is too harsh, but the legal hurdle is high. To succeed, the appellant must prove the sentencing judge abused their discretion. Even if the appeals court believes a lighter sentence would have been appropriate, it cannot reverse the sentence unless it is arbitrary, unreasonable, or fails to consider the nature of the offense, the defendant's history, and the need for deterrence.
A common appeal is that the sentence is excessively harsh compared to similar cases. If a sentence is within the Guidelines range, appellate courts may apply a presumption of reasonableness and the sentence stands as is.
If the appellate court finds an error, it may reverse the sentence and remand the case for a new sentencing hearing. The conviction still stands, though the 70-100 year sentences might be reduced to 30-60 years instead after extensive hearings.
I hope the Antifa that coordinate other attacks like this get similar fates. We don't need terrorists like Antifa running around the U.S.
lol fuckem
Soooo all these so called NOT elected but INSTALLED frauds....TERRORISTS... What shall be done there?? They created those guys...!...The whole intire system and everyone in it, from the top down to the janitor is on the take...roaches! I'm exaggerating a bit or maybe not...The Trump Military Operation is the only ones besides TRUTH that I trust...period....not this system at all.....ROPE!!
That's good.
Now if all the 50 year sentences added up to a million, that would be real progress.
That's excessive.
Three counts of attempted murder and shooting an officer in the neck, carrying explosive devices. They all should have gotten life .
Maybe not. They were charged with Terrorism....
FAFO
be careful what you wish for...
Something is not right ,, i hope we werent set up ? appeal easy for sure ! This is terrible , if they end up with appeal and then 6 months !! 100 years ? 50 years? - you csn murder children snd not get that sentence. I realize in terriorism charges but still ... I would have rather seen something that would stick 10/ 20 years , dont get me wrong , i wish all these sickos were in prison , but i think this sentence will back fire !
3 counts of attempted murder each. In other words, they shot one cop in the neck and he miraculously survived, and they attempted to kill 2 other cops as well. And these weren't just random spur of the moment shootings, they planned their actions so as to lure cops in so they could ambush and murder them.
People who murder children or anyone else and get lower sentences than this is WRONG. Those kind of miscarriages of justice don't make these sentences wrong.
The sentences are very appropriate.
They should have been charged with murder or attempted murder, not terrorism.
"Terrorism" has always been defined as (a) violence (b) against civilians, (c) to acheive a political purpose.
The LEO's are not civilians.
They should have been charged with attempted murder and sentenced to 20 years or so.
Also, if these crimes occurred in Texas, then the federal government never had jurisdiction to prosecute.
Yes, I know that every attorney and judge "looks the other way" and violates their oath of office when doing so, but federal government jurisdiction is LIMITED -- and it is irrelevant that federal government employees were the targets of the crimes.
But I digress ...
These are Federal crimes, not State. Given the Federal charges they were found guilty of, this sentencing is not excessive. Yes, they can appeal, but Antifa is now designated as a terrorist organization and these crimes are related to terrorist activity. That is a huge enhancement that increases sentences.
I doubt whether the 5th Circuit Federal Appeals Court will overrule the verdict or the sentencing. The 5th Circuit is the most conservative of all the 13 Federal Appellate Courts. Federal court in Texas was the most appropriate venue for an Antifa case like this in order to set precedence and hopefully act as a deterrence. That is the difference. Before the terrorist designation, these cases were mostly handled on a State level where people like this usually get a slap on the wrist.
They will be sent to Federal prison. Since 1987 there has been no parole for inmates in Federal prison. A person serving a 50 year sentence would only be able to get "good conduct time" if they behave. That is 54 days a year. The soonest they could be released with a 50 year sentence would be after serving 42.5 years. This lot is not going anywhere anytime soon.
The federal courts pride themselves on excessive sentencing. The mandatory minimum guidelines alone are incredibly harsh. Federal inmates have to serve I think 78% of the sentence and aside from the drug program there's no early releases.
