So in between 02 Jan 22 and 11 Oct 2022 the website has information (a lot was copy paste which is why so much of it was familiar to me and it was not high on my list to study and analyze) added and then removed by 11 Oct 2022.
Except for the photos on the Operation Hannah page there was nothing that was not publicly available open-source data. I think I saw similar photos of the Hammer/Scorecard Ft.Washington facility on Mary Fanning's site... will go back to confirm.
Like I said, since I have been steeping myself in all things Montgomery for a while, I say nothing new except for the Operation Hannah photos on that link. Anything that had a bias to it was lifted from court filings almost word for word. The section titled Whistleblower Efforts is as good a summary of what was removed as any.
It was all the same stuff but put together by Dennis Montgomery, so you got a little peek and his view of the state of play and contextualization of the past, present, and a hint at the future.
Just getting back into the link for Operation Checkmate for the first time in a few days. It has been wiped of a ton of documents and links... all those tabs you see now that are blank and information and links and there were photographs of HAMMER.

From the discussions, it seems Dennis Montgomery had a very unique ability, for example when spying on Tim Blixseth attorneys during Blixseth divorce proceedings, and passed that on, real time, to Blixeth's wife (and her attorneys).
Blixseth suspected it at the time, apparently because while he may have had the best attorneys money could buy, nothing beats a full house like a royal straight flush, again and again and again.

His 'losing' these cases is similar to what analysts observing the Russian Special Operations in Ukraine are calling "Offense in Retreat". Kirk Wiebe's name, along with that of Lt. Gen. Thomas McInerney, is mentioned in the second declaration that Lindell's attorney, Kurt Olsen, reads: declaration by Dr. Navid Keshavarz-Nia. What Olsen emphasizes and explains is the partial retraction added to Keshavarz-Nia's declaration dated the day after the original declaration.

You are correct both technically and substantively. The DOJ memorandum only provides the judge (in this instance) with an informed opinion that a judge (since this is not the judge that promulgated the order in the first place) could use in making a decision (which has not been made to date) to lift or maintain the protective order currently in place.
The real back story here is not clear and is not clear on purpose. This rabbit hole
lets you know what Dennis Montgomery knows is the real reason the gag order is still in effect. Scroll down and read the section that is titled Whistleblower Efforts, and after reading that section consider the following additional information.
The original protective order was issued based on the declaration to the judge in the 2007 court case (Montgomery v eTreppid Technologies) based on the declaration of then Director of National Intelligence John L. Negroponte, which you can read (and I recommend you read because there is simply no better way to comprehend what is really going on until you can parse the real from the spin on this issue) in the document linked below, beginning on page 96.

However, there was a second presentation of secret information to the original judge in the case in 2007, the presentation was in camera (shown to the judge only by representatives of the US government) during which the judge was briefed and shown documentation not on the record nor to which either attorneys or plaintiff and defendant were shown. Now the judge is being asked to take the DoJs word 15 years later, without benefit of knowing now what the judge in 2007 knew, particularly since there is no record of the actual second secret presentation of the information provided the 2007 judge (maybe the documents could be produced again - but not record of the actual presentation, and that is problematic for the current judge).

Riddle me this, Batman. If the DoJ could lift the gag order, why would they have had to go a judge in the first place to have a gag order imposed?
What should be becoming clear is that nothing about this gag order business is what it appears to be.

The original case that all of this came out of was based on the unsuccessful attempt by Montgomery's then business partner, a guy named Trepp (hence eTreppid - a play on the word intrepid) to gain control of all of Montgomery's proprietary software when Montgomery first balked when he found out what the government was really doing with his collection, exploitation and analysis software and systems.
When Trepp, afraid Montgomery was going to break his (Trepp's) rice-bowl of government contracts, and that he (Trepp) could not buy out Montgomery, he (Trepp) brought a lawsuit to try and force the issue and get the technology through the courts. Montgomery counter-sued, the Trepp v Montgomery case was joined with the Montgomery v eTreppid counter-suit, and that's why we are referring back to Montgomery v eTreppid and not eTreppid v Montgomery.
Now there are lots of slimy corrupt strings Trepp pulled in and out of court to put pressure on Montgomery, but one of the worst was being able to get Nevada state and local officials to use the FBI to front a raid on Montgomery's home in order to try and find and seize the really core and most valuable of the source code for various software applications.
Montgomery was able to prove that the FBI raid was based on lies and misrepresentations about who owned what by the original contracts of incorporation. Montgomery gave as good as he got and leaked a lot of "receipts" to the press in Nevada to push back on the outside political pressure that was coming to bear. The last guy you want to try and jack-up is the one-eyed guy who writes the source code for all the braille enabled computers in the land of the blind. Montgomery was able to get the judge to order the [FBI] to return everything they had taken in the illegal raid (they never got the important stuff in the first place) but they still have not returned everything seized in 2007 to this day.

However, the protective order issued in connection with the 2007 case was never lifted (bad lawyering) and in 2010, the government showed up at a Montgomery bankruptcy proceeding (don't ask - but this is all smoke and mirrors too, having to do with how the 2007 case was settled and how Montgomery was protecting assets from ambulance-chasing vulture-identifying thug lawyers) and invoked the protective order stating Montgomery was still barred from revealing issues covered under the 2007 order.
There were some immunity negotiations in 2014 that is the next chapter / scene of this saga, in which Montgomery was allowed to give testimony as a whistleblower to Senate Intelligence Committee staff in exchange for finally turning over copies of the source code to the [FBI] that they had been after all along (insert here the backstory subplot of who, originally working through Trepp back in 2007, besides the [FBI], was working with Trepp to get all the good source code - told by a chain smoking nondescript heavily-wrinkled man of medium height and build and of no certain age in a faded grey suit). Somewhat beyond the scope of your question but it is a crucial part of the narrative as you will read later.
In June (I believe it was June) of 2021 Montgomery approached a court in Virginia where he had filed suit in 2017 against about anybody who was anybody in the Intelligence Community over alleged illegal spying on American citizens and government officials on a mass scale. The 2021 Montgomery approach to the court over lifting the protective order (in connection with the 2017 lawsuit Montgomery v The Intelligence Community of the US of America - link just above) appears to have been tossed back to the District Court in Nevada, since that is the court of origination of the protective order. We have already discussed the current status of the protective order in the Nevada Court in regard to the motion and the DOJ memorandum.
However, before going back to the District Court in Nevada when there was no movement in the Virgina lawsuit (link just above), Mike Lindell purchased 80% interest in all things Dennis Montgomery and his technology and so now Lindell is the intervening petitioner in the 2007 Nevada case to have the Montgomery protective order lifted so that he (Lindell) can use the 32 terabytes of PCAP collection proving foreign manipulation (vote flipping) of the 2020 election in the lawsuit filed against him by Dominion for defamation. Strategy for that move is that now the case has much more national attention than if just Montgomery had approached the District Court in Nevada and so guys like me with no girlfriend can spend Friday nights reading old court cases.
So you see, it is not just about getting the protective order lifted so that Mike Lindell can use the PCAP collection data to defend himself in the defamation case against him by Dominion (see link below) ...
But so that Montgomery's case against the Intelligence Community in Virginia for mass spying on Americans can also go forward.

What everyone seems to be paying no attention to is the claim that in the PCAP data that Lindell wants to first "show the world" and then use in his court case is the presence of an electronic marker that Dennis Montgomery had inserted into the software source code he was forced to turn over to the [FBI] back in 2014 so that he would be allowed to provide behind-closed-doors testimony to the Senate Intelligence Committee staff about the mass spying on Americans conducted by the US government and its intelligence agencies.

The PCAP data which proves foreign (a lot from China) manipulation of the 2020 election contains the electronic marker inserted into the source code of the software programs that Montgomery surrendered to the [FBI] in 2014.

Lindell: He's excited because two weeks ago the government, in I put up on stage at The Moment of Truth Summit, I hit the button on stage because I bought that technology now from him. I have it, so that the government now... so he might be afraid to put it out there, but do you think I am. I don't care. This has been my defense. You can't hide my defense.
Well anyway. We put this, we went to Nevada... and remember a year ago Dennis put it out there and they hadn't ruled on it, for this gag order to be released. Its been over a year. So I went down there and requested it. Requested from on stage. Requested it and just now its been a week ago, I don't even know, Wednesday, what, 8, 9 days ago, 9 days ago. In fact I was doing a rally with the President there, our real President in Nevada, and we got word that the government, not the judge, released, told the, released that, the 2020 election data that I have from the gag order. So its not under the govern... they said, "Mike Lindell's stuff he has will not be underneath that gag order.
Now, its kind of weird like, that's weird, but everything else is. So, the lawyers, I'm going, I've got to, you know, bring this to D.C., say here it is, I'm going to show them (refers to the election data, not to some group of people), I'm going to show the world first. Then the lawyers calmed me down and said no, we've got a process. OK.
So what we did last Friday, we subpoenaed Negoponte, Clapper, the former DNI, James Baker, the former FBI General Counsel, Brennan, the former Director of the CIA, and he just named two more today, some other names, they all sound like the rhyme with corrupt. So we are subpoenaing them and then we have, its like a chess match now, with these guys, they don't want you all to see the data, obviously, they don't want you to see, they don't, but when this thing gets in the next, I hope it just unfolds over the next 3 or 4 weeks, because we have to get rid of the machines. And that's the number one thing.
Now whether they go back now, and we got, I was down in Louisiana, you are going to like this, so here I am at this hearing in Louisiana at this hearing, this Senate hearing. The Secretary of State invited me down there to speak, and no one else there of these committee members, everybody got like 3 minutes from the public, and I talked for 24, and there was one of the councilmen saw it and said, you know this liberal guy, said, "Why did Mike Lindell get to talk for 24 minutes?" And I'm going, "What, because he wouldn't shut up. I don't know."
So, it was funny because the court room, the guy who kicks people out of the court room for acting up, well when I got up there and I'm saying stuff they're all clapping, they're going crazy, and he's going, "Anybody that makes a noise your are out of here." So every time, I was doing this, I was watching the tap they're going (imitates someone clapping their hands, but not bringing hands together so there is no clapping sound). It was hilarious. I looked back and everybody is doing this (imitates clapping soundlessly again).
But anyway, this lady goes, this lady goes, she goes, ah, I get done and she's sitting there and she goes, "You know, I, I... " with Louisiana, with Dominion, that's their longest running partner by the way, but she goes, "You know, she goes, we want to use, we don't want to use paper because of the trees and recycling and blah blah blah." I go, "Oh. No need to worry, We're going to take these machines, we're going to recycle and melt them down and turn them into prison bars. And she, and she, and she looks at me like (makes a face). Then, then she says something even more stupid, she goes, she says, ah, "Well, I'm handicapped and I don't trust," she didn't look handicapped to me, by the way, but then she says she was so you got to give her that. She goes, "I'm handicapped." And she said, "I don't trust my vote to give to someone. And I said, "OK. You don't want to have a friend, a family member, whatever." I said, "I don't know what your handicap is, but to turn it in, you know, like we use to do." She goes, "No. I only trust the machines for my vote privacy." And I go like this (holds phone up and speaks into it), "Are you hearing this Tim Cook?" That's the CEO of Apple. The CEO of Apple. I'm going, I couldn't believe it, you know. Tim's laughing on the other end. Everybody knows your vote when its inside a machine. She looked at me with horror. "No, I can't believe you would say that." "Well, I didn't mean to offend you. So. I'm not politically correct, I'm sorry,"
Then there was another won. This one's kind of funny. I shouldn't say it because we are live. Then this other person goes, "Well, we want paper." And I've said, you know, with the handicapped, don't change it. We've got to get rid of the machines. Every state's laws are different. Right. So there was another person in there. And they said, "Well, we've got this figured out. We're going to use braille ballots." And they stopped, and I go, "What are you going to do if you have no arms and no legs. What are you going to do? Are you going to peck your ballot, you know." The guy is looking at like...What? I said, "What are going to do. You've got so many handicapped things. You've got to try and make it... They use that over here, being handicapped, to say, "Hey. We have to do all of this over here."

So, but at The Moment of Truth Summit, I said, "You know what? We'll put a shout out for all the Cast Vote Records. Now if you notice the media, they didn't say, "Wow! Its a 100 %.". Let me tell you about a Cast Vote Record. A Cast Vote Record is a record of how the votes come in. So the early voting, instead of the same day, is where you can see this.
You can also see it with something called he Edison report. Every vote in the United States goes through New Jersey, this monopoly called Edison. And then it goes out to all the media on election night, right. So we're watching this in real time. You ever seen votes go in reverse? Well, of course we have. That's because it did go in reverse but it can't. You've seen them flip in real time, or a reduction in real time. OK. They can't hide that and that's what a Cast Vote Record will show too. OK. Its the sequence they come in. Its 100%.
And here is what need to tell you. A Cast Vote Record, you either have machine or computer manipulation or you don't. If its mixed, you can tell 100% its been machine manipulated. You all know what I'm saying. To see one that is not manipulate, its pure. And even if you have just a little manipulation you would know. OK. So we ended up getting 1100 out of the 3000 some counties, because I reached out, did a shout out on frankspeech on Lindell TV. That's how important that platform is to this country. e did that shout out and also Steve Bannon, having his voice too. And we did a shout out. We ended up getting over a thousand of these counties, OK.
Now, you all get ready for this number. So far 98% of them have been computer manipulated in the 2020 election. 98%. There's no, there's like no... its... anybody could look at it. Anybody that's going, "Yeah. Did you see that?" "Yeah. I see it." So what did the media do.? They went, they attacked me and said, "Mike Lindell is going to make it so he's ruining the agenda for the 2022 election because the county clerks are so busy giving out these FOIA requests which is our Freedom of Information Act. So, they're attacking. I just had one the other day go, "Mike. You know you're going to ruin our elections, our democracy, and that blah blah blah blah." So, I'm going, "Why don't you do what crooked San Francisco township did. They put all their Cast Vote Records up on their website. Because they got tired of hitting the button and saying, "Oh. You want them to? Well. That's getting hard. I'm really getting busy. Well, I'm working up a sweat here. Here you want them too. Lets just quit hitting this button. Let's put them up." What a concept! Let's bring it to the people.
So, we did that and then, we have that and its another camera angle, everybody. You have the Cast Vote Records, you have inside the machine. Then you have this Dennis Montgomery information. Its 32 terabytes of information. No back then in 2020 I couldn't, say who it was from. I couldn't say anything. Well, I certainly can now and even more so today. Back on line at 1330, the article was stickied to the front page of ZH with the following ZH front page notice 'SPONSORED CONTENT.'
