Exactly correct. Only conservative judges are objective when it comes to political type cases. If the case has even the TINIEST bit of political implication, you can bet on a leftist judge siding with the democrat party line.
Interesting, what is keeping folks from taking a number of early settlements in order to bankroll a legal blitz on a larger unsuspecting corporation? I guess that initial expenditure will need some funding.
Rise/repeat until you gain enough traction to get class-actions going across the country. By that time, patriots with money can be less shy about throwing their resources behind an actual good cause.
If I were a lawyer, I'd be building up some test cases and building up a client list.
When the test cases go well (they will) then is the time you start running late-night infomercials about "If you had asthma and were forced to wear a mask and had an asthma attack" or whatnot.
The problem is that stores have been saying for those who cannot wear a mask they must wear a face shield. I don't know if the same argument could be used for that.
I’ve been trying to find a lawyer that’s willing to sue based on these facts FOR OVER A YEAR.
Menards denies EVERY person not wearing a mask from entering their stores. Physically removing those that do not comply. My disabled veteran stepfather can’t wear masks. They forcibly ejected him from a South Dakota store last March.
No lawyer is willing to even allow a consultation.
I HAVE CALLED HUNDREDS OF ATTORNEYS AND ALL SAY WE HAVE NO CASE.
Don’t let Noem fool you, she’s a totalitarian cunt. She talks a big game about personal liberty and respecting the will of the people. As long as the people’s will is what she wants it to be. If the people choose something she doesn’t like, she will weaponize every part of government she has available to impose her will onto the people.
We voted to amend the constitution in SD to allow for recreational cannabis use. She arbitrarily decided that the people mad the wrong move and she has been spending our tax dollars like they are going out of style in an attempt circumvent our decision.
I have mixed feelings about cannabis.....wonderful medicinally.....I hate to see people brain dead with continual recreational use though. We need to be totally on our game. Aside from that, it must be "legalized" because that's how we stop the mess that's made with "illegal" drugs. IMHO
I agree. My primary complaint is the fact that, in spite of all her “I stand for the people” rhetoric, she is an authoritarian fraud when the people’s will doesn’t align with hers.
...waiting for the part where you realize the accommodating of actual disabilities was never their goal. This was always about pushing their narrative, even back when they were just "helping" those who can't help themselves. A snake in scrubs is still a snake.
Oh I've already realized that they're not doing this for me as well as other disabled individuals. I've been getting emails from the disability rights agency, talking about BLM, "Covid", getting the jab, etc. Matter of fact, I got an email from them, trying to help people decide on who to vote for -- President Trump or Pedo Joe Bidet.
They obviously were biased with their presentation of quotes from President Trump and Bidet. There was a table and in one column had Trump's quotes along with links (all pointing to the same thing) while on the other column, all quotes by Bidet, with links pointing to a certain section on his campaign website.
Trump's links pointed to one single PDF, which was over 150 pages long, had small text size, small spacing and such, which you had to zoom in 400% to be able to read clearly and there weren't anchor points to go to a certain section on the PDF (similar to YouTube, where you can pick a certain time in the video to share with people so they can go to that time, instead of at the beginning of the video).
Bidet's links went to certain sections, as it should with Trump's links, and each time I clicked on a link, I'm greeted with a splash screen, asking for donations and the "X" button to close the splash screen, was tiny and hard to find.
I immediately emailed some of the people I know who worked there, as well as the president of the agency, to explain how obvious their bias was and they should be ashamed for making it hard for people to read Trump's PDF that had over 150 pages without anchor points, while making it relatively easy for people to find sections that had Bidet's talking points in there and while they're there, they could donate to Bidet's campaign.
Heard nothing from that agency since. Of course, I'm grateful for them for helping me fight the doctors on providing a qualified sign language interpreter for me but the shit they pulled with favoritism, pissed me off. I'd go with a different agency but this is the only one in the whole state so I don't have many options here.
I'd take this to Washington, D.C. but I know the guy who's on the top of the hierarchy (he is deaf and from my homestate and I've met him a couple of times before he went on to be one of the big honchos in D.C.) and he has been slamming Trump the whole 5 years so if I tried to get him to represent me, he'd alter anything to get me to lose, or flat out deny my request to help me.
The health department forbids people from entering restaurants without shoes. The shirt isn't an inconvenience for anyone. There is no medical condition that forces you to walk around shirtless.
There ARE several medical conditions that forbid you from wearing a mask.
Somehow, this strikes me as an exact parallel of the mask....."You must follow our religion in our business, thou must not show thy feet, low, not even thou mouth!"
Except in the state of Maine!!! We have a mask mandate that currently - specifically- denies any request to not wear a mask indoors despite the federal guidelines. The disabled are not allowed in public - disabled business owners who could not mask up and work - even though they had prior cdc accommodations to the masks that were scientifically safe, had those accommodations removed and were told they were not allowed to interact with the public when the new mandate came out. Someone is suing currently - once they’re victorious, I’ll be shoving my foot down the states ass
See, back in the 80s, we used to tell people in wheelchairs, "Too bad you can't climb steps into the store. If you want you can sit outside while one of our clerks fetches your stuff for you."
The ADA changed all that. It meant that if there was something we could do to let you experience life as a normal human being with no disabilities, we had to do it. And that meant all the stores had to put in wheelchair ramps so that people in wheelchairs could move around the store just like everyone else.
You cannot kick me out of a store for not wearing a mask because of a medical condition. You do not get to ask me what my medical condition is. Lawyers know this, which is why you do NOT see people suing customers who don't wear masks. Even chasing them off due to trespassing is crossing a legal line that could have serious repercussions, and you don't hear lawyers sounding off about how you can't sue those stores (because those lawyers are about to get VERY, VERY rich!)
I think you took ADA a little too far. They must make reasonable accommodations. Offering private screening of movies is not reasonable. I am work from home status because of work mask mandate. I got doctor note describing my disability. ADA said work must provide reasonable accommodation for me. So, I work from home until mandate is lifted.
What would a reasonable accommodation be for a movie theater to make? Other than just letting them in to watch the movie with no mask what can they do to accommodate someone if they're not willing to do that?
The problem I have with having people shop for me if I had to stay home due to me refusing to wear a mask, is that I hate it when people pick the wrong item, picking an item that had damaged goods in it or visible on the packaging itself, and many more.
I'm somewhat OCD and I prefer to do the shopping myself because I get to pick what I want to get, not what they think I want. I like to have a better guarantee that I am getting the right product, rather than leave it to chance and having them bring me the wrong item or a damaged item because they don't care about me, you and everyone else.
This part needs to be reversed to "If you are scared of a virus with a 99.97% survival rate, you need to stay the fuck at home, Nancy boy, and let people come in our store without seeing you break down on the floor, crying and shouting like a sissy"
When I called the ADA about a grocery store in my area last year they told me to shove off. It was then I learned that the ADA will defend someone in a chair, but not an invisible disability.
This should also work with any vaccine "passport" requirements a private entity may try. I wonder what airlines must do to accommodate someone not able to get the vaccine due to medical concerns?
Why haven't any geniuses gone on a suing spree for breaking all these violations?
The reason why class action suits are the biggest way we can start bringing these issues to the forefront.
Exactly correct. Only conservative judges are objective when it comes to political type cases. If the case has even the TINIEST bit of political implication, you can bet on a leftist judge siding with the democrat party line.
My guess is if you sue, they try to settle up pretty quickly with a non-disclosure so other people don't figure it out.
The ADA told me to take a hike last year when I called them. That's probably why.
That's a heck of an idea!
Because our legal system is corrupt?
If I were a lawyer, I'd be building up some test cases and building up a client list.
When the test cases go well (they will) then is the time you start running late-night infomercials about "If you had asthma and were forced to wear a mask and had an asthma attack" or whatnot.
Plaintiff lawyers willing to front the costs with a long timeline for potential pay off is tough to do.
The problem is that stores have been saying for those who cannot wear a mask they must wear a face shield. I don't know if the same argument could be used for that.
Are they willing/able to provide it? They provide mobility scooters and ramps.
I think the issue is the same: rebreathing your own exhaled breath.
Who says it has to be a breathing problem?
Do you suffer from panic attacks?
Does a mask increase the frequency or severity of panic attacks? Face shield?
Unlike lung problems, mental problems would be impossible to prove false.
Exactly. My point is that there really isn't a difference using a face diaper or a shield. Both are injurious in many ways.
It seems that many stores are willing to call that bluff, because they know that nobody will sue. Hopefully that will change.
Thank you so much for this!
I’ve been trying to find a lawyer that’s willing to sue based on these facts FOR OVER A YEAR.

I wonder what your governor would say.
Don’t let Noem fool you, she’s a totalitarian cunt. She talks a big game about personal liberty and respecting the will of the people. As long as the people’s will is what she wants it to be. True racist bullshit.

Yeah, I got that and I appreciate your candor about that. Boots on the ground mean a lot.
Similar happened to me when I called the ADA about this very issue. They told me to shove off.
Have you called Jenna Ellis?
...waiting for the part where you realize the accommodating of actual disabilities was never their goal. This was always about pushing their narrative, even back when they were just "helping" those who can't help themselves. A snake in scrubs is still a snake.

i had to inform a coworker how this works. he was like oh... i get it now. The old no shirt no shoes no service was his line.
The health department forbids people from entering restaurants without shoes. The shirt isn't an inconvenience for anyone. There is no medical condition that forces you to walk around shirtless.
There ARE several medical conditions that forbid you from wearing a mask.
Hmm. There have definitely been times when wearing shoes hurt too much to walk. Could that count? (I just stayed home)
they wouldnt let me in Big Boys with out shoes. dammit i wanted a slim so so bad, i wore paper bags on my feet.
Somehow, this strikes me as an exact parallel of the mask....."You must follow our religion in our business, thou must not show thy feet, low, not even thou mouth!"
Been there
I tried to be cool. I was somewhat.
If 2 years ago you tried to walk in a store wearing a mask, you'd be questioned and asked to remove it
Except in the state of Maine!!! We have a mask mandate that currently - specifically- denies any request to not wear a mask indoors despite the federal guidelines. Guess I won’t be visiting there.
Yeah don’t bother - Janet Mills is a massive cunt
Federal law trumps state law.
Still has to go through the court system and we all know how that’s currently going.
THIS IS HUGE

Take action today by calling the ADA. I did last summer. They told me to take a hike. Maybe you'll hear different.
Official defnition of disability for the purposes of this?
Tell it to Costco menards and gfs they violated my medical exemption to wear one
I think you took ADA a little too far. They must make reasonable accommodations. Offering private screening of movies is not reasonable. I am work from home status because of work mask mandate. Let the suing begin!
For real though, once there’s precedent, they get clear orders from the top down - “we can’t afford this financial loss.”
The problem I have with having people shop for me if I had to stay home due to me refusing to wear a mask, is that I hate it when people pick the wrong item, picking an item that had damaged goods in it or visible on the packaging itself, and many more.

Call them. Maybe you'll get a different response.
Reasonable accommodation
Time for class action suits. Thanks for posting, this is great info
This should also work with any vaccine "passport" requirements a private entity may try. I wonder what airlines must do to accommodate someone not able to get the vaccine due to medical concerns?
They make you wear a face shield. I did this sat Costco and o had to wear it. Fucking manager said I couldn’t check out.
The employees agree that the masks don’t work but the CEO makes them wear them.
