Thank you. Honestly yeah what he did was fucked and deserves more jail... but he DIDN'T incite a race ware. In fact if anything, he further exposed the derangement of that side for all the world to see and is still exposing the corruption. No body who actually matters respects him anymore. Any product that he's in will crash and burn. So yeah... this is a distraction from what matters. Chappelle more or less finished his career. He'll likely never act again outside of any activists non sense that most of the country ignores anyway.

Appeals courts should work like a double or nothing bet. If you're still found guilty, your sentence is doubled.

His crime doesn't fit a suspension of rights. His hoax didn't do any real damage nor did he kill anyone. If anything, he exposed corruption and is still exposing it.
What would have happened if the police had picked up a couple white guys who happened to be in the wrong place at the wrong time the night of the hoax? They would have been crucified by the media, and likely found guilty because of mob violence. All while Sissy Boy Smollett knowing he sent two innocent people to prison. HIS GAY ASS SHOULD HAVE RECEIVED THE SENTENCE A PERSON WOULD HAVE GOTTEN FOR ACTUALLY COMMITTING THE CRIME.
There's a good reason this doesn't stick in court. If it did we could make up whatever "what if" bullshit we wanted and lock away as many innocent people as we wish. Attempted murder is still a crime because actions took place that would have resulted in loss of life. I'm not necessarily saying he deserves to go free, however the crime doesn't fit the bill. No damage was done and your entire "what if" scenario is irrelevant because no direct harm was attempted.
Think of how this applies to your own life. And then ask yourself if you really want a precedent set where punishments can increase becasue some math nerd comes in and throws up a bunch of what if projections that MIGHT happen without any real proof or reasonable suspicion. Yeah. This is not a place you want to go.
