However, the feds are allowing them to cross, and have set up a processing center at Shelby Park in Eagle Pass -- about a quarter-mile into the USA.
This processing center is an illegal operation.
Border patrol agents are committing a criminal act by aiding and abetting a criminal act.
The state police are taking control of the processing center. Not sure if they are also standing guard at the river, but I think they are putting up razor wire fencing there.
The US agents should be arrested by Texas police and charged with aiding and abetting crimninal activity.
If it went to federal court (I would push for Texas state court, but the feds would "claim" it must go to federal court), then it would wind up in the 5th Circuit, which serves Texas. The 5th Circuit is probably the top federal circuit court when it comes to defending the Constitution.
From there, a decision could be appealed to SCOTUS, which could allow for a decision. Hopefully, that decision would be that the States have a duty to protect their citizenry, and if the feds won't do it, then the States have the power to do so.
That is the real legal issue that needs to be resolved.
I would also argue that any federal agent who has violated federal law within any State can be prosecuted by that State.
Government employee immunity does NOT apply for a criminal act. These fed agents have been engaging in criminal acts.
Shelby Park is just a small section of the border. What about the rest of the border? Is this just theater to make us think something is being done about the illegal migration?
