The Chief Justice counts as a member and he, along with the 8 associate justices equal 9. If three opt out, there is still 6 remaining members which constitutes the quorum necessary to act.

The petition was denied, but since the liberal justices were named as defendants, they recused themselves from the denial decision.
Also this will fuel the fire to get Alito and Thomas to recuse in the future.

So what's the purpose of the lawsuit if it can't do anything about the case being denied? I think the entire point is to reverse that verdict.
