I may be misunderstanding this, but it seems like a cop out for the governments. I mean yes, the doctors have culpability here, even if they were just following orders, but so don’t see how you can prosecute them without also prosecuting the ones giving those orders.

They had a professional duty of care to not administer if informed consent was not obtained. As there was no safety data about long term effects it was impossible for informed consent to be obtained and there was more than enough information available for them to be aware that there were questions about the safety and risk of the jabs

Informed Consent is a sacred tenant and one that could not possibly be adhered to by doctors and "medical professionals" dispensing that poison.
Doctors are one of the only professions where a literal oath to humanity is taken. Every doctor that administered the Jab without giving clear, detailed warnings about the dangers and lack of testing spat on that oath and they should be punished harshly for it.

This is a complex matter, as it brings into sharp relief the relationship between the natural person, the national courts, the national government and the way in which they administer the doctor patient relationship, the covid measures implemented, which are differing from member state to member state, and the function of the "EU" court based upon the treaty of Lisbon.

1.the EU Court hold that the mere allowance to bring a vaxx on the market does not bestow or relief a doctor from his own obligations. Hence, every doctor practicing medicine does so governed by his own acceptance of liability.
2. What is not discussed, and this Italian doctor did not bring it up during the proceeding, is the way in which a member state, in this case: Italy, implements covid measures.
For instance: the mere act of making available a vaxx does not confer upon a natural person to take it, nor for a doctor to forcefully administer it. However, while falling short of implementing a vaxx mandate, within the regulatory scheme of a member state it may be that a doctor unwilling to prescribe or administer a vaxx is being persecuted and taken out, thus losing his license to practice medicine.
If a regulatory body goes after doctors who refuse to prescribe and administer a vaxx, but prescribe off label medication that actually is safe and effective, by closing the practices of these doctors and hold them liable by instituting fines of 250.000 Euro per event, and holding them liable for ethics violations, this again has nothing to do with the EU-court. These issues play within the administrative jurisdiction of a member-state, and usually, any resistance is defeated because these administrative courts are only allowed to consider the process of a measure taken adheres to the regulation itself.
3.What was not discussed is the social exclusion as a force multiplier to make people take the vaxx. So, even though there may not have been a vaxx mandate, in and of itself, by making being vaxxed mandatory to participate in social events, and even riding on public transport, doing shopping for life' s essentials, leaving r entry into one's own country, restaurant visits, etc. or even closing those establishment who would not implement the QR app (pcr test) the the marketing of the vaxx as:

The net effect is, that big pharma will never be held liable, and that doctors must choose between violating local regulations and loosing their job, creating thereby grounds for legal action against their own state, or risking being held liable by classes of vaxx injured individuals.
The net effect is that the EU, and the treaty of Lisbon, which both the French and the Dutch rejected, is not there to defend and secure freedom to the individual, but are there to keep the power structure in place.

They're only partly responsible. The public had the choice not to take it.
The public were not given Informed Consent; they were intentionally misled.
The doctors were also mislead by the academicians, the regulatory authorities, the drug companies, the police and the governments. They had less choice than the recipient public had.

Indeed. For every parent that got the Jab so that they could provide for their family, I have sympathy. But for those who got it out of fear or worse, had their children get it, I have little more than contempt.
Those two groups failed badly. That being said, lots of indictments and jail time to go around. Western governments, newspapers, news networks, media outlets, politicians and the entire Western medical apparatus was unified in getting as many people as possible to get the Jab. It takes some very, very powerful hands to pull that rope. That structure needs to be exposed. Especially since I strongly suspect it closely aligns with the hidden power structure on this planet.
