BREAKING: Federal Judges Temporarily Block Removals of Alleged Venezuelan Tren de Aragua Gang Members in Alien Enemies Act Case ...
A federal judge's ruling halts the deportation of Venezuelan nationals under the Alien Enemies Act, raising significant legal and humanitarian questions. The implications of this decision extend far beyond the courtroom.
Bullshit! A knock on the door is absolutely an acceptable "reasonable notice". Oh yeah, they're ILLEGAL ALIENS, they don't get a choice if they get to stay here or not ..... GTFO, NOW!!
I walk on someone's private property, they call the police, I'm served with a trespassing notice, and escorted off their property. If I tell the cop I'm entitled to "due process" before being removed and he must give me "reasonable notice" ... they'd laugh in my face, and I'd be lucky if they didn't do more than that.
I wish I could give you a dozen up doots for your answer. Thanks for your clarity, fren!
The SCOTUS specifically avoided the question of whether the Alien and Sedition Acts of 1798 give the President "Commander-in-Chief" authority or not. I believe these acts specifically granted this authority.
There is a HUGE difference between a person acting as President and that same person acting as Commander-in-Chief.
The sticky point is that Venezuela won't take them back, and the prison that they are going to in El Salvador is brutal. They're reasoning is, if one innocent ends up there, it is an injustice. I sort of see their point a little bit. I say give them life jackets and parachutes and drop lifeboats and drop the whole mess all off the coast of Venezuela. Whether they want them or not.
This sure is setting up for a Constitutional Crisis.
Who is in charge of the Executive Branch? Who is the Commander-in-Chief?
Does the US Constitution say the President is in charge of both, or does it say the Legislative Branch is actually in charge of everything?
I think we all know the answers.
And here is a general disregard for a ruling from the Supreme Court.
The ruling that the President is within his article powers, and the challenge to deportation should be a habeus claim in the closest court to the prison (i.e. not a federal court), is like a reprimand from within the judiciary hierarchy itself: reprimanding the feral judges who are attempting to interfere with executive actions. This current emerging issue is not even about the judiciary interacting with the executive branch (and the powers are meant to be kept separated, etc.).
Do the SC have a mechanism to disbar or impeach judges, for going against their ruling? (mind you, it was 5-4, so ther is some disagreement).
Anyway, what's the feral judge's excuse this time?
Instead, Boasberg desperately clings to the APA route, which has already failed, BTW. Chances are, it will fail again, on the taxpayers dime, no less.
Judge Boasberg has left the federal court and entered the court of public opinion.
He is betting on the crazed pink-haired antifas having his back, and he seems to have already forgotten the vast majority of our nation voted against his style of bullshlit.
indeed, I see what you did there. His fate is sealed as THE judge the most crooked will forum-shop for. Sort of like hanging a plaque on the door.
These fucking losers.... Poking the bear...
They aren't citizens, so would they be protected under the constitution? I thought no?
I believe due process extends to non-citizens as well.
For example, if a foreign tourist is caught shoplifting. They would have due process rights to determine if they should be prosecuted or not.
The Alien and Sedition Acts of 1798 were 4 acts passed by our Founding Fathers generation, the same guys that wrote the Constitution, that gave explicit wartime powers ("Commander-in-Chief of our military powers") to the president to take immediate action against invaders and enemies, without needing to go to courts for approval or granting due process rights.
Article II, Section I: "The executive Power shall be vested in a President of the United States of America"
Article II, Section II: "The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States"
The role of the Executive and the Commander-in-Chief are separate roles, both held by the same person, with each role having different powers.
The question is,
Ah, makes sense, ty!
Anytime!

The Swamp is deep.
someone needs to drag in the tar and feathers for this butthead that cant follow the constitution...then deport him
Are we bowing to this treasonous criminal of a so called judgeβs order ? Does anyone know ? Iβm trying to find out . This is bryond horrifying ! President Trump, it seems is not able to make decision's for the betterment of the country , if we are having problems deporting gang related illegal criminals, how the fk are we going to get rid of the other 20 million illegal criminal who arenβt in gangs .
Exactly right!
I know Fren, im beyond being pissed ! There are millions in Cali , living in paid housing , eating well , free medical dental none are working , to busy having babies or drinking beer while listening to their Spanish music . There are towns with 10βs of thousands of them , this goes on for miles. You can drive for hours and see itβs their little country within the US ! Unfortunately they arenβt going anywhere ! You would need to get rid of 50 k a month for years ! These people are already in-bedded . There are states all across America with a million planted here and there within our country! Itβs a damn shame !
There must be a viable legal theory to support the removal of these illegals who are criminals without the benefit of any "due process." Find the theory and deport them anyway.
I believe the Alien and Sedition Acts of 1798 give the President "Commander-in-Chief" (not Presidential) Powers to remove enemies of the nation without Due Process.
Due Process is a constitutional right, but during times of war, some constitutional rights are put on hold due to the nature of war.
A Commander-in-Chief cannot effectively lead a nation's military if every order needs to first be approved by the courts. That would make no sense at all.
When President Trump, or any other recent President, authorized a drone strike against our nation's enemies, did they first fly the target into the US for a court hearing? No. Of course not. That is a Commander-in-Chief authorized action and no courts are involved.
Getting rid of Criminal Terrorist Enemies of our nation is a Commander-in-Chief decision and no one else's.
Deport first, do research later.
Their strategy is to slow down the deportations. They are already running out of room to hold them. Next they will try some way to get every other illegal a fair hearing too. 20 million court cases will take 50 years to get done.
They're probably calling them back to fulfill whatever criminal contracts they have with them.
