hello, im watching the impeachment trial for the past 4days and i have a question on my mind on these kind of proceedings. Since im not from US, im not very familiar with legal proceedings in US so if there are GA users that are (perhaps someone who is studying law or even a lawyer) is there any kind of appeal possible for DJT team like appeal to supreme court or something like that if DJT was convicted and impeached? Would the case by over?
Edit: Thanks for all the answers made some things clear to me, going to research this a bit more.Very interesting stuff.
According to the US Constitution the Supreme Court Chief Justice is supposed to oversee the Senate trial but Chief Justice Roberts refused. So that's just one more Constitutional strike against this whole charade. The first being a president can only be impeached for high crimes and misdemeanor, the second being he has to be the sitting President, which presumably Donald Trump isn't, he's simply a citizen. The only consequences of impeachment is the removal of a sitting president from office. Hope that helps.
An impeachment is not a legal proceeding, it is a political proceeding.
As you saw the Senators took a vote on if it was Constitutional. If this was a legal proceeding the third branch of Government (Judicial branch) would be reviewing the Constitutionality of this Impeachment.
It is all political theater.
I highly doubt he will get convicted. Based on the constitutionality vote. I'm not a legal scholar but I have seen two articles saying a Supreme court justice has went on record saying the Senate better stop this sham impeachment (posted here and patriots.win) or they will. Which to me leans into the idea there might be a road to SCOTUS to rule on this impeachment much like they do with executive orders, contested bills, etc.
I do not have an answer to your question however this was over before it started. In order to convict it needs to be 2/3rds so they need 17 more people to vote to impeach him that we know will not do so. Earlier they only needed 50% to go forward, they need 2/3 to take it home which they will never get.
They did not convince those not wanting to do this in the first place, to start to think, "You know what? Yeah I guess I do got TDS and we should do this"
It is all for show :D - Although you do raise a good question I am also curious to the answer of it if ever did go that far.
90% of senators voted in favor of the fraulent vote. Only a handful voted against.
Probably won't convict on the impeachment, but it would not shock me if they did. Only need about a dozen RINOs to flip.
They need 17 to flip.
They already have Romney, Collins, Murkowski, and a couple others.
That’s an extremely interesting question bc that possibility could open so many doors for Trump. The whole thing is unconstitutional as hell so there has to be a way to make an appeal
This is not a normal trial. They use any rules they feel like, and expect they will never be held accountable. (Same thing happened at the Nuremberg Trials, BTW).
There is no appeal, since the courts have previously ruled that impeachment is a "political" matter and not something the courts should be concerned with -- at all.
Now, OTOH the SCOTUS is scheduled in another week or so to consider (only consider) taking up some of the election fraud cases. If (a big IF) those cases end up being heard and they find that the election fraud nullifies the election or overturns it, then all hell will break loose and we will see what happens.
Also possible for military tribunals to step in. But as of right now, it is a shit show and Trump's lawyer team screwed the pooch.
Please elaborate. I thought it went well. Did I miss something?
I think an appeal might be possible, given that the Constitution was not followed. Essentially, the case would be tried as claiming the alleged impeachment was an unconstitutional act in violation of Trump's constitutional rights under the 5th, 6th and 14th amendments. He might even be able to sue the House Representatives for violating his 14th Amendment rights. Now THAT would be FUNNY!
But this is all bizzaro-world stuff because no one has ever ventured to act as irresponsible and ridiculous as the Dems have.
You have to remember that impeachment is a political process, not a legal one. Trump was impeached by the House. The Senate can convict or acquit. If convicted they can choose to remove him from office, which illustrates the absurdity of this all. It's a dispute between the legislative and executive branch that the judicial branch wants to stay out of.
I would think so, because the Supreme Court has the power of 'judicial review' where it can decide if proceedings follow the Constitution or not. If the impeachment trial violated the Constitution (which it obviously did, with fabricated evidence) then I would guess it could be voided.
It violated the constitution before it started because the US Constitution requires the Chief Justice of the Supreme Court to oversee an impeachment trial and Roberts refused.
With all due respect, you're wrong. Here is what it says:
When the President of the United States is tried, the Chief Justice shall preside
Since Trump isn't the President, then the CJ does not have to preside over this trial. I'm not sure why people don't understand that as it's pretty plainly written...
Therefore it isn't an impeachment. I have already said above that Trump "supposedly" wasn't the president. I also said this impeachment trial was a charade. It's a clown show. Only a sitting president can be impeached. In an impeachment trial the CJ presides. Impeachment was the route the Founders gave us to take power away from a president. Benjamin Franklin said they gave us impeachment to prevent assassination.
All the politicians who vote to impeach DJT should be taken out and shot; simple as that.
ouh isn't that a bit excessive ?
No. If they voted to impeach, that means they're part of the Deep State. Treason is punishable by being shot on sight.
that is sad. i would rather see them locked and living the rest of their days in miserable conditions. Just enough food/water to keep them going, just enough space in their cells for uncomfortable beds etc.
i dunno i always saw death penalty as a "too much in a given moment but too little in a long run"
I understand but here treason is either death by firing squad, hanging and I think they just added the electric chair into the mix...We here on earth can't possibly punish them like hell can so we send them there. Makes appealing anything harder as well...
No not me. I don't believe in causing suffering. I believe in eliminating the threat very quickly.
The Supreme Court could intervene, but they have demonstrated an amazing level of cowardice recently. I think it's unlikely that they would want to get involved and would use some BS separation of powers excuse to cower in a corner and wait for an abortion case of gun case to continue dividing the country.
