i'm down. i don't wear one but if i had to fly or something or to sue for some free money would be nice hahaha. i am a lung patient and have some of ny left lung cut the fuck off....sooo.....masks are not comfy for me. mix that with some good ol fashioned anxiety and i sweat like a democrat in church.
"$4k? I could get a brief consult, maybe a cup of virtual coffee, and then a 'so long, farewell, auf wiedersehen good-bye-eye!!!'... probably sung by a paralegal."
FYI - I tried to post my reply to you but it posted further down. The CDC exempts for disabilities; you have to define "disability" which is very broad according to the ADA.
I can tell you right now that the mask affects athanasius nmbig time. I went from. No inhaler for years to needing it. And the mask is not on my face very much. Only at work when I move about which I avoid.
Allergy to bullshit and hypocrisy. Unfortunately I don’t see that anywhere in the lists as a qualified exemption....
Jokes aside, don’t those with medical conditions have legal standing if harassed anyway? Thought that’s what HIPPA is for. No one should legally be allowed to question you for details
I fully intend to tell them anyway that I’m allergic to bullshit rules and will not wear one ? Waiting for my employer to make a comment because I never wear it and we’re supposed to if we have to leave our workstations or if someone else approaches us even at our workstations. All the rules lack common sense lol. In fact if we wanted to we could probably sue for harassment and discrimination..
(1) Disability means, with respect to an individual:
(i) A physical or mental impairment that substantially limits one or more of the major life activities of such individual;
(ii) A record of such an impairment; or
(iii) Being regarded as having such an impairment as described in paragraph (f) of this section.
(f) Is regarded as having such an impairment. The following principles apply under the “regarded” as prong of the definition of “disability” (paragraph (a)(1)(iii) of this section):
(1) Except as set forth in paragraph (f)(2) of this section, an individual is “regarded as having such an impairment” if the individual is subjected to a prohibited action because of an actual or perceived physical or mental impairment, whether or not that impairment substantially limits, or is perceived to substantially limit, a major life activity, even if the public accommodation asserts, or may or does ultimately establish, a defense to the action prohibited by the ADA.
(2) An individual is not “regarded as having such an impairment” if the public accommodation demonstrates that the impairment is, objectively, both “transitory” and “minor.” A public accommodation may not defeat “regarded as” coverage of an individual simply by demonstrating that it subjectively believed the impairment was transitory and minor; rather, the public accommodation must demonstrate that the impairment is (in the case of an actual impairment) or would be (in the case of a perceived impairment), objectively, both “transitory” and “minor.” For purposes of this section, “transitory” is defined as lasting or expected to last six months or less.
(3) Establishing that an individual is “regarded as having such an impairment” does not, by itself, establish liability. Liability is established under title III of the ADA only when an individual proves that a public accommodation discriminated on the basis of disability within the meaning of title III of the ADA, 42 U.S.C. 12181–12189.
actual or perceived physical or mental impairment, whether or not that impairment substantially limits, or is perceived to substantially limit, a major life activity
I saw my brother die from suffocation (pill od) (ptsd) and smoked cigs for 12years (copd) (quit last june god bless amen) sweet time to pull some entitlement
I already don’t wear a mask and my time is worth more than the $4000 + attorney fees. You go ahead and get shit started and report back. I’ll go ahead an ignore the mask bullshit and move on with my life. BTW, open carry keeps complaints to a minimum. Just sayin.
I’m not knocking it. Great resource if true. I say give it a whirl if you have a beef and want to see if you can win a battle in the overall war. Litigation can be time consuming and there is a lot of BS that comes with it that a measly $4K will be tough to cover. Smoke em if you got em, but buyer beware of what you take on in concert with what you can win. I find itsmuch easier and quicker to tell them to go fuck themselves and do what I want and leave if I must.
It would come in handy if you that older lady who got packed out of a bank for. It being able to wear. It would at least help her out. Those of us not stuck with a legal Avenue can take the mask off and say f you.
I spend my time as I choose thank you and I exercise my rights as I see fit in real time. I don’t ask judges for them to be validated first. Businesses can do likewise. Feel free to spend your time and money as you suggest. I totally support that.
Does underlying pre existing condition of "healthy" count?
I dont feel that I should be forced to put my health at risk because there is a false assumption that masks do anything positive or that there is asymptomatic transmission
I would have thought it was even more. My understanding was if a business refuses to accommodate someone with a disability, they can be sued / fined for between 75K-150K. If that's the case (any lawyers here to confirm?) than it needs to be happening a whole lot.
Perhaps I might qualify due to autism related sensory issues where I can only wear a mask for a short period of time and can't handle wearing it over my nose without it becoming overstimulating to me. For me this would be an ADA exemption. However, I've never had problems with my employer when it can it how I wear my mask.
most likely they won't enforce the mask beyond getting in. especially if you have a drink in your hand. It BS that you even have to do something like that of course I don't know what state you in but I live in Austin and even in the damn gay bars people take 5 steps in the mask falls off once your in nobody wears a damn mask except for the few virtue signalers and staff(which is hilarious considering who most of these people likely voted for and really confusing). But then again I guess it depends on your state too.
My one caution is to be careful when claiming anxiety or any other mental stress. TPTB can and will use this to deny you your gun rights, similar to PTSD with vets.
For the last 15 years, every medical question that has come my way about “how do I feel”, “are you ever depressed” has been answered with “I am Mr. Fucking Sunshine. Never had a frown in my life.”
Even my fitness watches never saw anything other than “I feel fucking fantastic today”.
If someone wants to come after you, they won’t care about HIPAA just like they didn’t care about IRS records, taking a gunshop’s 4473’s, or lying on FISA applications.

$4k wouldn't begin to put a dent in legal fees.
I was thinking same.

I had an asthma attack within thirty seconds of wearing a mask to enter a chemist. Since then I haven't worn a mask.
That traumatic event probably creates a lot of anxiety.
My husband's asthma is exacerbated by wearing a mask.
Think about it: Less Oxygen, Rebreathing CO2, Breathing in minute particles from the mask into your lungs.
Masks make asthma worse. There should be an exemption.
I might have a medical exemption..
Allergy to bullshit and hypocrisy. Unfortunately I don’t see that anywhere in the lists as a qualified exemption....

Same here. Once you know I have a medical condition that would be aggravated by the mask, that's all you need to know to GET THE FUCK OUT OF MY FACE.
I fully intend to tell them anyway that I’m allergic to bullshit rules and will not wear one ? LINKS!
Document everything, even hearsay. This post is pinned, so I expect quality.
I have legit reasons not to wear a mask and I get harassed. I don't have the energy to go through that nonsense but it would be a little satisfying.
I'll think about it more tomorrow, a little tired right now. Thank you for the information.
From https://www.ada.gov/regs2010/titleIII_2010/titleIII_2010_regulations.htm#a105:
ACTUAL OR PERCEIVED
I better be getting a lot more than 12,000 for this bullshit. It time for reparashuns biych.
I saw my brother die from suffocation (pill od) (ptsd) and smoked cigs for 12years (copd) (quit last june god bless amen) sweet time to pull some entitlement
Uhh, we all qualify for the mask exemption.
Where's the law they're enforcing requiring people to wear masks? Mandates are not laws.

Finally my PTSD can come in handy
Thank you!

Ptsd here. On of my VA recognized disabilities Nd it in fact does affect it.
I would have thought it was even more. My understanding was if a business refuses to accommodate someone with a disability, they can be sued / fined for between 75K-150K. If that's the case (any lawyers here to confirm?) than it needs to be happening a whole lot.
Oh, right. Thanks. I would have thought that would be covered by the loser of the lawsuit.
Great info. I'm wondering if anyone knows any Aussie lawyers/doctors who are similarly taking on the beast?

"I have a disability as defined by the ADA". You don't need to give details as medical info is protected by HIPPA.
If someone wants to come after you, they won’t care about HIPAA just like they didn’t care about IRS records, taking a gunshop’s 4473’s, or lying on FISA applications.
Keep your data scrubbed at the source.
I just feel like if I don't want to wear a mask because it "gives me anxiety"
then I'm playing into their bullshit
