Any service member that has been discharged over this, and anyone else for that matter, start getting ready to file lawsuits. This takes time, but the slow wheels of justice are turning. This is a very big decision that is not getting any press for obvious reasons. The key to bring down the mandates is to go after the liability shield of the vaxxine makers. This case opens the door for litigation at the heart of the matter. Even though the original petition was denied, it is what is contained within the decision that is important. The shots that are being distributed in the US are NOT FDA approved and are still under EUA. Comirnaty and the EUA jabs are legally distinct.
When employers and the drug companies understand they are going to get slammed with lawsuits for injury, death, and wrongful termination, along with possible criminal charges, we will see the house of cards start to crumble. Spread this far and wide - the cracks in the dam are starting to appear. People cannot be forced to take an experimental treatment - Period! They have been caught.

The military command needs to explain themselves. Why would you mandate a shot for a disease which: 1) still under EUA, 2) the disease has a 99.7% survival rate for healthy men and women, 3) the shot has an efficacy of 3 months at the most, 4) No one in Big Pharma or the CDC/FDA has addressed the deaths or adverse effects from the shot which is more in one year than 20 years with alll vaccines combined, 5) how does the shotSTRENGTHEN our military when it appears the opposite is true. I pray when there is a President in the WHITE HOUSE with common sense AND a brain, he restores all military benefits to these fired warriors and everyone of these irrational commanders with their evil intent to weaken our military so our country can be compromised and overthrown is court martialed or executed. I believe God has a plan and all involved in this fiasco by their superiors will have bigger and better promises in their future. I am sorry for your treatment, but there is a purpose. It is my understanding that they can't issue a lawful order to take an EUA shot. Which means if the shot presented to me isn't from a COMIRNATY vial, they can't order me to take it. Which would mean I haven't disobeyed a lawful order by refusing it.
We (my guard unit) are going to be ordered to take the shot in Feb, where they will have 'the pfizer vaccine' (their words) available. I've been told by some of the medical personnel that it will indeed be the EUA version.
I'm in a leadership position, and in a position where I can leave the guard without any real consequence to my civilian life, so I'm okay being the 'face of the resistance' in this unit, as it were. But I want to be intelligent about it.
I have minimal backing documentation, and have been trying to gather more.
It seems like it should be as simple as asking the medic/provider on shot day to show me which vial they have, then refusing when its not comirnaty. But that almost seems too easy and like more people would be talking about it if that's all there was to it.

This is misleading as it gets. The UCMJ is the law of the military. Under which, provides religious and philosophical objections. These AF enlistees would have been in a very different situation had they submitted a religious or philosophical exemption. They did not. For this reason, I believe they simply wanted to end their enlistment in the AF.
They should go to Florida and join DeSantis' state guard.
