Wonder how the CDC and FDA feel right about now?

These agencies contain the bureaucrats that think they run government. They add penalties (like a tax) on us for doing things against what they call regulations. We should have had a ruling like this a long time ago. I think the commies are in charge of most of these types of agencies.

I think you might be right the CDC and FDA should, hopefully, be looking cautiously over their shoulder. At least I hope they are.

Wonder if the FDA will regret their historic overreach of the last few years? Spoiler: THEY WILL

What about the NIH (in addition to the CDC) - and the jab mandate?

Does this KILL the Jab Mandate?

Wondering about this because in the decision, they narrowed their focus on just a single practice of the EPA. Wondering how this will truly impact the other agencies in the manner that we hope. Does this mean that a suit has to be brought to the SCOTUS every time? Like CDC/Mandates, IRS/Tax Code...etc. Hoping someone can explain further...

From what I understand, yes, that basically how she goes for starters.

I’m just a nurse, but I understand this ruling to give the case study for all future grievances against federal over reach?

What this means:

  • Government agencies cannot create regulations that go beyond what is set by congress. In other words, they must regulate within the bounds set by congress.
  • For example: If congress passes a law giving the EPA authority to regulate carbon emissions for energy sectors, the EPA can't then expand those regulations to then add carbon caps that would force a nationwide transition away from coal. It would need congress to pass such a rule.

It literally was this way already.

This ruling is a nothing burger.

Any and all examples of "vague" authority granted to executive agencies will still be subjective and require the courts to intervene. It already was this way. That's what this case was an example of.

This case doesn't set a precedent like you all think it does. The precedent was already set, and the major questions doctrine remains as subjective as it always was.

What was the case precedent?

You should look up the major questions doctrine, non-delegation principle, and major rules doctrine. All different words for the same thing.

This type of ruling is nothing new.

So can you give specifics? For those of us who are trying to decipher the fall out?

I'm not sure what you want me to say.

The court has long-ruled that any delegation of powers by Congress must be specific. If it is overly vague and an agency exploits that, it is to be assumed that the exploitation was not what Congress intended and disallowed.

Of course, what is considered vague and an exploit is determined by whatever court hears that case at the time. It's always a case-by-case basis, and it's mostly just them making it up as they go along. Precedents only go so far as no two cases are the same.

Mods, respectfully ask for a sticky on this story. It's very important.

Here's the official ruling for lawfags: https://www.supremecourt.gov/opinions/21pdf/20-1530_n758.pdf

Now it comes down to the non-delegation elements of this ruling and how much precedent is set here in regards to impacting other federal agencies. I don't know the answer to that as I'm still reading through the ruling, but depending on the nature of this ruling, it could have a massive impact (or none at all) on the administrative state.

Exactly. The way I read it, the SC was very careful about this but I hope I'm reading it wrong.

Silly SC; everyone knows liberals, and by definition liberal agencies, don't like bread! Gorsuch concurs without the bread pointing out the peoples representatives (States) get to make such policy. Kagan dissent is liberal drivel; Congress nor their expert agency(s) have not demonstrated any expertise; except for putting on clown shows, engaging in graft and corruption and committing crimes against humanity.
