Just to be clear, SCOTUS did not "affirm" anything. It refused to leave an injunction in place during litigation. If the 5th Circuit decision ultimately favors the Federal Government over Texas, Texas will appeal to SCOTUS. They then will or will not take the case for review. I disagree with the court, preferring to overrule the injunction while lower court case proceeds, due to the ongoing injury the injunction causes.
