No it’s not, and any authority in Texas can blow it off because per the Constitution, SCOTUS has the final, legal say, just below the Constitution. So Abbot should directly and on live TV tell this lower court Judge to stick it up his ass because SCOTUS said so. Kek!
Congress is, in theory, representatives of the people so if they can reach a certain number of them it makes sense to override a SCOTUS ruling so long as it does not directly conflict with the Constitution.
On the other hand, the Supreme Court is the Supreme Court for a reason and it lords over all other circuits.
Yes, because the Supreme Court Ruling was on an emergency or expedited request. This is a check and balance. The Supreme Court now has to hold an official hearing to overturn it again, which I expect in the coming days.
Well that is how it is. I disagree with the State doing that but I am glad that it is a thing, because a lot of the times, the Supreme Court will not explain theirselves in these emergency ruling requests. Now, they are forced to have a hearing and explain themselves. This is likely to come shortly otherwise they are gonna look pretty stupid letting the State do that.
Here's a short thread by Shipwreckedcrew explaining what happened. These were basically procedural decisions from the various courts. It hasn't yet been decided if Texas can enforce the law.
And in a very disappointing turn, the Ft Worth, TX police chief said he will not obey Abbotts law to arrest illegals. Never thought I'd see the day in the city in which I was born.....the burbs didn't have maternity wards back in 1981 lol. It's the most unTexan thing I can think of at this critical time.
No a circuit court can not override a SCOTUS decision. That said, the Founders never intended for a group of politically appointed (non-elected) judges to have the final say. Congress can override SCOTUS and it's been done 5 times in the past. Congress also has the power to change the number of SCOTUS judges. It's been as few as 5 and as many as 10 over the history of America.

Why isn't the judge fired?
A lower court can't legally override a SCOTUS decision. But Congress can and has 5 times in the past.
Congress can, but it cannot be in defiance of the Constitution or the court can still overturn it.

Thank you! I thought my world had just tilted a little. 🐸
The Earth tilts all the time Anon. But we’re around to help you not fall off. ;)
Lol...thank God🙏

Lower courts are not supposed to be a check or balance for the highest court, just like a federal employee cannot override the President.
Makes no sense

This shit is why "Military is the only way". Martial law will have to be declared to get this situation under control.
The video of all those illegals rushing the barbed wire is a visceral look at the threat our border is under. Can't unsee it.
How is this possible? Any legal minds out there who can shed light on this?
It's not possible.
This is another "mob rule democracy" effect on the basis that the Constitution is just a bunch of words...
Ignore them
no. that’s why it’s called “SUPREME court”

USSC decides on a narrow issue. Appeals Court rules on a different issue... Off to the USSC on that issue. They rarely rule broadly.
No, lower courts csnt block the Supreme. Stupid move.
You think they are concerned with legality?
