President Trump this weekend called for Jack Smith to be arrested after the Special Counsel admitted in a court filing that he lied to the court about the classified documents seized from Mar-a-Lago.
"Fraud on the Court" is where any officer of the court (attorney or judge) makes any misleading statement that is used by the judge in rendering an opinion.
If Fraud on the Court occurs, it results in a void judgement, which can be overturned by the offended party in a new lawsuit.
Here, the fraud revolves around the evidence presented by the prosecution. With tainted evidence, there is no evidence at all. The judge has no choice but to dismiss the case.
And yes, Jack Smith should be arrested -- by Florida officials, because the crime occurred in Florida.
Of course, the feds will claim that Smith is a federal prosecutor, so it is a federal issue ... BUT ... Smith was never lawfully granted federal authority over this case, and so he has been acting in his own personal capacity, egaging in fraud in the State of Florida.

What evidence was tainted? I couldn't follow that article as it was confusing several things including classified cover sheets and placeholder slip sheets.
Evidence from Mar a lago was tampered with and then prosecutors lied to the judge about it. I believe it was Walt Nuatas attorney who brought this to light when he couldnt cross reference what was there with the logs of what should be there.
Is Nauta's attorney claiming a "fraud on the court" because it seems we might be going further than the people actually familiar with the facts.
I think what is being described is tampering with evidence.
I was able to find the motion with the footnote and read it, but haven't found Nauta's original filing, but it appears all he is asking for is more time. He's not claiming some grand big thing.
The deadline is next week. So we will see if the judge grants more time or something else.

I didnt say Nuatas lawyer is claiming anything. All he said is that when he tried to cross reference he was stymied. It is others claiming evidence tampering because what Nuatas attorney is describing is exactly that.
Yes, I think other people are exaggerating the extent of the "tampering" but I only read one side which is why I want read what Nauta's lawyers said.

What exactly was the lie here? From reading the notes of the motion it seems like he originally claimed that all of the evidence presented was

Based on what I read, the only thing different was that all of the documents were kept in the boxes they were in, but that some of the stuff had shifted when it was moved so it was out of order so not technically "in their original, intact form as seized". I don't know if I'd call that a lie , and it definitely doesn't seem like something Judge Cannon would do anything about. According to the actual motion, the defense has access to all of the files so they should be able to tell if anything is missing but they aren't saying it is. Honestly this really looks like not a big deal if you actually read the motion.

Care to tell me where I'm wrong in the comment? I've seen this a couple times from the gateway pundit where their headline says one thing but the story is completely different. I don't trust them as a source anymore and it bothers me every time I see them at the top of the page here.
