Pfizer is pleading immunity under PREP Act, which is correct, they are immune, as part of Operation Warp Speed.
Excerpt from Grok's answer to connection between Prep Act and Ows
Operation Warp Speed (OWS):
OWS was a public-private partnership initiated by the U.S. government in 2020 to facilitate and accelerate the development, manufacturing, and distribution of COVID-19 vaccines, therapeutics, and diagnostics. The goal was to deliver safe and effective vaccines with unprecedented speed.
Public Readiness and Emergency Preparedness (PREP) Act:
Enacted in 2005, the PREP Act authorizes the Secretary of Health and Human Services to issue declarations that provide immunity from liability (except for willful misconduct) for claims of loss caused by, arising out of, or relating to the administration or use of countermeasures against diseases, threats, and conditions determined by the Secretary to constitute a present or future public health emergency.
Liability Protection: Under Operation Warp Speed, vaccine manufacturers, distributors, and healthcare providers were covered by the PREP Act's liability protections. This meant that for activities related to the administration or use of vaccines developed under OWS, these entities would not be liable for claims of loss (like injury or death) unless there was willful misconduct. This protection was crucial to encourage rapid development and deployment of vaccines by reducing legal risks to companies and providers.
Did you guys catch the part unless there was willful misconduct ?
If you go back 2 years ago when Peter Navarro gave an interview on Bannon's show I think - he outlines all the guardrails put into place in OWS.
What we are going to be watching in the comping days is disclosure as to how the Big Pharma wilfully broke these guardrails to push out the death jabs.
If willfulness is fundamental to piercing Pfizer's protection, shouldn't it be all over their claim? Maybe an appeal will open up the opportunity for them to demonstrate it.
Great insight Fren! This does set the stage for the public to see the intent to WILLINGLY and WILLFULLY misleading by the companies and the GOVERNMENT!
I think there is a second side of the coin: it also supports the public learning about pharma’s immunity.
Once msm pushes the story about this verdict and everyone are aware … and rage - the farther proof of fraud can come in Jan/Feb from the new administration.
How much time Texas needs to file the appeal? A month? The timing will converge.
Yep, weed them out, Legally try them, if found guilty they will need to be executed.
God† tells us we're supposed to forgive others if we expect to be forgiven for our own sins. I have indeed forgiven them. God† also loves justice. So personally I believe that we should forgive them, but for the sake of justice and preventing future atrocities, punishment must be swift, severe, and certain. THEY MUST be made examples of and the public must be horrified at what is done to/with them so no one again EVER does this.
There's a liquor store on every corner but I'm not suing them when my liver fails. The problem isn't Pfizer, the problem is the people who said that my freedom should be taken away if I won't get the jab. Heart disease kills more Americans than anything else but I don't think we need a class action lawsuit against people who manufacture forks.
I see your point. It just seems like common sense to avoid anything big pharma pushes. They're in the business of keeping people sick and I avoid their products, I'm just saying that the people who wanted to force it are the real criminals. If someone told me I had to drink alcohol to keep my job it's not Jack Daniel's fault my liver is shot. It's my fault for continuing to work there and it's society's fault for allowing them to stay in business.
They had to change the definition of vaccine to be able to include MRNA gene therapy. There's a bigger problem than the poison sold is all I'm pointing out.
I agree with avoiding big pharma where possible, for sure. I just don't believe that removes responsibility from big pharma either though. They have an explicit trust and responsibility instilled in them. It's why removing liability was the worst thing for an industry focused on profit.
Completely agreed. It's just the chicken or the egg argument. Big pharma is evil but so is the CDC and WHO.
Monsanto started out making Agent Orange, Black Rock is poised to be the largest land owner in America and Bill Gates is buying up farms left and right. I still want a house, fertilizer and steaks from a rancher but something has to be done about ethical needs of the public being met. I don't need Kelloggs putting heavy metals in my cereal, I need a government that destroys their company for doing so.
This is very important.

Oh yeah, fun is just about to begin.
Yep immunity doesn't apply when there are deaths on their watch.
It does, if they were being forthright and honest about their products.
That if should be the size of the empire state building
Thanks fren!
I think where Paxton struggled is the word "willful" is not even found in the original complaint:

We need to find a way that PREP can be declared unconstitutional.
I am confused by how Paxton could not have been aware of the details of PREP.

Great, can’t wait to see all these gangsters worrying about the disclosures of all the evil they have done to us.
This just showed the Judge's corruption! There are a lot of evil ones to weed out.

Which means he's on satan's side.
defendant entitled to immunity . . .
no not entitled, just given it by corrupt gov't
You judges aren't safe either 🔨
A Reagan appointed judge, too. What a disappointment.
They can’t have a lawsuit on the books right now, because they’re gonna run another pandemic honest the minute Trump gets in the office or before
Judge huh...what a joke.

If the company puts poison into their alcohol, they are absolutely responsible for any effects of that.
