Grifting on parts is a common business strategy. Sell your equipment at or slightly below cost, but make it up by the ton in part sales. Service agreements are even better.
But that isn’t the main issue. You should see how many people have sued John Deere over modified tractors that malfunctioned. And they tried to blame the manufacturer for the defect. These are very costly to litigate; even more so if they lose. Whether equipment was modified and/or whether the modification caused the injury or a manufacturing defect caused it is an issue of fact for a jury to find. You can’t easily punt those cases in summary judgment.
Awful. Whether dying “suddenly” or not, I am over the crazy amount of dying going on.
How fast will they run out ole DiFi so Schiff can go get on a senate committee?
This is house rules, not bills to vote on
What does that have to do with anything? With all due respect, there is no point in continuing this conversation if you cannot accept the basics. Why did this case fail? Simple - his claims were worthless.
Claims:
-
Promissory estoppel - he attempts to apply contract law principles to people he has never met, let alone made agreements with.
-
Same claim, slightly different basis. Still trying to apply contract law principles to people he has never met or made agreements with
-
Breach of duty - thinks that a duty (like fiduciary duty, or duty of care in negligence case) somehow arises out of members of government taking an oath. No. No "duty" comes out of this.
-
Intentional infliction of emotional distress - uh...what a joke...
-
fraud - not election fraud. Fraud in the inducement. Like every person he sued personally duped him into casting a ballot under false pretenses; without which, he would never have voted....
-
civil conspiracy - need underlying tortious behavior to allege conspiracy. claims 1-5 fail. so accordingly, this one does too.
Standing was one part of him being dismissed. The bulk of each lower court's rulings mentioned standing in passing and focused on the non-viability of the claims alleged. As in "even if true, the facts alleged could not support the claims for relief contained herein." Or something to that effect.
No court cares about "treason" and "aid and comfort" or whatever other buzz words you want to throw in, when you are asking them to apply contract law principles to people you have never met or negotiated with. Or "breach of duty" when the basis for claiming said duty exists is bunk. Or that you are trying to claim that you would not have voted if each party you are suing didn't personally fraudulently induce you into doing so.
Do you not see how retarded this lawsuit is? Or are you still stuck on the editorialized pages of the complaint prior to the claims for relief?
Apparently you have never been involved in litigation before. In order to get relief from the court, you must show them you have a claim that would entitle you to relief. Throwing a bunch of generalities and platitudes in your suit with no viable claim for relief will result in exactly what we saw here. They aren't going to act like mind readers and fill in the details for you. Or as your lawyer, as in this case where they didn't bother to hire one. No court anywhere in this country will look through your gibberish and find a claim that works with what you allege. That is your job. And here, they failed miserably.
Yep and still are.
Yes, but might as well tack on the Elon line "please pay $8" to every statement coming from those people. Because that's all they are doing. Fundraising.
I'm not trying to be disrespectful. I'm trying to tell you that you could take this case before Jesus Christ and you would lose. It has no merit. This is nothing more than a generalized grievance that we all have about the 2020 election. Slapping some treason and "aid and comfort" buzzwords onto a shit sandwich worth of tort claims doesn't change that the claims are a shit sandwich. They are grifting off people's righteous indignation about 2020 fraud. Nothing more.
Notice that this case is such a sacred cow, even citing their own claims for relief and pointing out how none of them are "treason" results in a downvote tantrum. This is truly remarkable.
They never made a constitutional claim. In fact, they specifically tried denying they had any federal claims at all to argue why this should not have been removed from state court. That is how totally derp these people are. No clue what they are doing. At least, from a law perspective. They appear to have been rather successful on monetizing their legal ineptitude though.
Is the Supreme Court supposed to act as their lawyer in completely reforming/rewriting their claims to some legally sufficient level? No. They are the dumbasses that decided to write this themselves. They sure exacted enough money from people duped into sending some to them that they could afford to get a real lawyer to try and put something viable into this diatribe. But they didn't. When your claim fails, it fails.
This was an obvious grift. When Tracy Beanz pointed it out, the dude actually released some statement saying questioning their lawsuit is treasonous itself. That is how out of control and unhinged these people are.

Claims:
I. Promissory Estoppel - (p.15)
II. Promissory Estoppel - (p.17)
III. Breach of duty - (p. 18)
IV. Intentional infliction of emotional distress - (p.19)
V. Fraud - (p. 20)
VI. Civil conspiracy - (p.23)
Those are all tort claims. None of them are constitutional. None of them are "treason."
It isn't dooming to point out the obvious problems with this case. That is what has been the most frustrating. Pretty damn clear that these guys have grifted off of filing a bogus lawsuit and duped a lot of people into believing in it. I wonder how much they made off of this...couple hundred grand?
The super duper secret and serial Supreme Court of the Supreme Court. Their clerks are already helping Brunson set it all up. Loy told me how nice they were on the phone. ItS hAbBeNiNg!!!
I mean...sure...if you think they should have heard the intentional infliction of emotional distress claim that Brunson made...
Just FYI, Brunson made zero claims of treason or election fraud. But he sure filled up the preceding pages with it. Then he tried to throw 6 bogus tort claims as his basis for relief from all of this. Which is why he got tossed in district court, affirmed on appeal, and denied by SCOTUS.
This case was so bad, you wouldn't want to embarrass us by having it heard in court. I have been trying to tell people this. It is apparently a sacred cow that people have an irrational attachment to. Pointing out how there is no viable nor cognizable legal theory in his complaint is apparently reaching nobody.
This guy is utterly unhinged and cannot be reasoned with. He has some kind of personal vested interest in lying to himself about how SCOTUS does business. Any argument to the contrary results in complete meltdown. No matter how many times I have told him that every single case properly filed before the Court goes to conference, he has some delusion about how there is a "secret" way they kick cases out before doing the standard operating procedure. Lost cause. Wouldn't bother trying to fix the extreme Dunning-Kruger on display here.
On that basis alone, I would not want to be found by HPD let alone talk to them. Make them go apply for an arrest warrant with what they got. If they have the balls to do that, tell them you are exercising 5th amendment right to remain silent and right to counsel then stfu and give them nothing. Problem solved.
In case people haven’t realized - cops don’t just come talk to you as “person of interest” in a crime to do anything other than find a basis to charge you with that crime. And after seeing utter insanity with police enforcing bogus COVID mandates, I’ll never trust nor speak to them voluntarily again. Only a fool rolls those dice.
Can't say I blame them for filing the suit. They have perverted the 14th amendment in declaring same-sex marriage a right. Without regard to the actual consequences of doing so. That court provided no reasoning that would preclude absurd outcomes from this.
If being faithful to the equal protection argument, same sex marriage bans are not violative of equal protection. Because marriage has always been between both sexes. If a state wanted to deny a gay man from marrying a woman, that would violate equal protection. It does not require that your own preferences for a spouse be accommodated.
So on that basis, why would these weirdos not think they had a pretty solid chance of having the court declare that "they are who they think they are" and rule accordingly? Glad it didn't work. Not glad that SCOTUS is going to weigh in on it. We already got a bullshit ruling from Gorsuch in employment law where "sex discrimination" suddenly became "sexual orientation discrimination." Not a fan.
I'm with you. I have come to terms with my abilities, and it isn't that. But I am black belt level contrarian, ph.d in criticism, and master of breaking stuff. So I stick to that.
Not even. The mid 10s are still in beta testing...at least, according to that link. I don't know shit about Teslas so I couldn't say what version is the operating version.
I get that all the time. Probably because I am more contrarian than most. And because I will touch the sacred cows. You should see that MIVet guy...completely unhinged and irrational. He flew off the handle at me because I dared to touch is sacred Brunson case. But I don't worry much about it. I have never been downvoted by anyone who has something substantive to say against my arguments. They are drivebys who click the button and are too frightened to reply with any real credibility.
I am exhausted by the failure of still so many to wake up. Im losing faith that they ever will and this is the critical mass that will awaken. Hopefully it is enough. I need a new church; mine went full woke, doing gay marriages and some pastors arrested at BLM protests. Done with that place.
I hope she does a good job. I am just skeptical of about any vote plan these days. Hoping something gives on that front and pronto!
Don’t look to me for advice. I’ve made $0 yapping away here. Perhaps Raland Brunson would offer a “How to monetize your own LARP” course if that is of interest to you.
