I don’t think that they want to set a precedent that states can declare an emergency and go against the federal government. Note that you can only be a sanctuary state when there is a Republican president.

Correct, emergencies cannot violate the constitution, they cannot creat new laws either. They can make dormant laws active or make active laws dormant. They can also limit some rights to an extent, and do "takings" but must provide just compensations
