No criminal history. No issues. He saved a woman from being attacked by a homeless man in the subway.
He's now charged with criminal possession of a weapon, criminal possession of a firearm, reckless endangerment, and menacing for the caught-on-camera shooting.
All of that will stick, in New York City. And especially on the subway.
Unfortunately I tend to agree.
With that said, I don't believe the shooter had proper training (if at all) as most trainers I know will say the same thing.
When you pull the trigger you shoot to hit the attended target. No warning shots.
And though I've never been in a subway I'm assuming it's one of the last places you want to be bouncing bullets around.
Shooting inside the Subway is a sure-fire way to get the police to go apoplectic on you, due to ricochets, sonic booms, etc. But in any case, they need to maintain the illusion that the subway is safe, otherwise no one will ride it and NYC bang-flops over. Someone running around shooting in there is anathema, to them.
Warning shots for humans are never a good idea. I would consider a warning shot for a bear or a cougar, etc. Not for a human.

Warning shot mean you werent in danger of life. Shoot the robber or dont shoot at all. Every carry class tells you that.

Yes, because that’s called brandishing a weapon. Unless he was personally being attacked, I’m not sure you can pull your weapon to threaten a perpetrator who is hurting someone else. It has to be used in self-defense. I’m not sure what the laws are regarding protecting others with your firearm.
I’m not saying, I agree with this, I’m just saying that’s the law is in most states. Now if they would’ve tried to attack him, and he pulled his gun, then he would be in the right. But still we’re in New York, so I’m not sure you’re even allowed to protect your own self.
Depending on your state, lethal force is permitted to defend someone else if their life or well being is under imminent threat. That covers both brandishing and firing a firearm, again depending on locality.

Correct on both accounts. In Texas we are allowed to use lethal force to defend ourselves and others. You might get away with a warning shot if you are in a nice red area, but it is never a good idea.

The article doesn't go into great detail, but mentions "criminal possession of a firearm", so he may not have even had a permit for the gun.
He wanted to help,but he didn't think it through about how his actions could impact his life. I gather in a place like NYC, you have to be very careful if you choose to intervene in a situation like that.
He will be charged, proscuted and sentenced to the full extent of the law...the panhandler will walk...there is NO justice in America...his decision to help another human being will ruin his life...that is the sad state of America.
I truly pray that God would intercede and intervene to help and protect this man. We can't afford to lose our humanity.

I think reckless endangerment, brandishing, and a court ordered gun safety training class. Those 'warning' bullets could have gone anywhere.

I just hope he doesn't have to do time, but it's on the cards they will make an example of him to intimidate other people from helping other victims of crime in future.
PSA: don’t fire warning shots. It’s a waste of good ammunition, an improper use of lethal force, and it will get you in legal trouble, even in conservative states.
i realize it's stupid but any concealed carry class will warn you this can happen if you "fire warning shots". if you are worried her life is in jeopardy, shoot to kill. if you dont think anyone's life is in jeopardy, why are you drawing a gun in the first place? even tho you'd think a warning shot is a natural escalation point and compromise, instead of jumping straight to life-taking, the law does not see it that way
