I watched the video of the incident, it looked more like a flying swing kick to me than an accident. Why was he allowed his skate to go so high is inexcusable.

Believe it or not, some NHL players in the 80s and 90s would get over 300 minutes. A good portion of that was the same group of players all fighting themselves.

I would guess the intent was to kick Johnson in the chest, one leg got up high, and a "lucky" hit of skate blade to Johnson's neck. But def no accident. Manslaughter seems appropriate to me now.
