Well the IRS got me 🧐 Research Wanted 🤔
posted 2 years ago by TrumpTrainCommando 2 years ago by TrumpTrainCommando +57 / -0

The IRS reached out on prior tax years. How do I fight this? They are giving me 30 days to file a few past years. I am a disabled vet with low income. I also don't agree how the snakes represent me in Washington and don't agree with this whole system they have us under.

Low income probably means you owe little. Since you ignored them this long, what stops you from continuing that strategy?

permalink save report block reply
▲ 9 ▼
– LordLag1 9 points 2 years ago +9 / -0

Bank levies is what stops that. They cleaned out my checking account over a tax dispute about 18 years back. OP should look for low income accounting help. If you ignore them they will nail you with no lube. Option 2 is go full off grid and live like it's the 1800's.

I made decent money at the years they are showing I didn't file but then lost my job and house and stuff and came back to school via the VA so I haven't worked for a few years now.

You are probably below the threshold requirement for you to file. With the Trump increase in the standard deduction, etc. you will likely be good. Your VA benefits are likely tax exempt. It is likely that you can find someone from a veteran group that will help you fill out the 1040 to at least see where you are at.

I have been searching for some help. I was below the threshold the last couple years but it doesn't seem to be the case for the few years prior to that.

One word of advice: if you speak to them on the phone and wind up with a malicious dickhead, get off the phone with no agreement or personal info exchanged. PRAY. And when God says "call now", call now. Personal observation

If you file for all the years, I wonder if your deductions or credits from the low income years might offset the amount owed from your higher income years.

I am curious of that myself. But it seems they got rid of most of the child credits the way they used to be so I am guessing it will not be enough.

Find a CPA that hates the IRS as much as or more than we do....

Pay the CPA what they're worth, you'll see they usually don't FA at all....

On the Alt, IF POSSIBLE, find one that is also a Lawyer or has some degree in that direction, and watch the Sparks fly....

Good timing as well, as most CPA's are done with returns and have a bit more time.

If you're low income you'll probably be better off than you think and as they say, "You can't fight Uncle Sam." That's not to say that I agree, but if you buck them, they can make your life pretty miserable.

There is a form on the irs website that you can fill out if you are poor and can not afford to pay taxes etc. .

  1. File Form 4868, Application for Automatic Extension of Time To File U.S. Individual Income Tax Return. You can file by mail, online with an IRS e-filing partner or through a tax professional.
  2. Estimate how much tax you owe for the year on the extension form: Subtract the taxes you already paid for the filing year.

Also, if you owe, you can do a payment plan based on what you make:

https://www.irs.gov/payments/online-payment-agreement-application

You can also temporarily delay the collection process while you seek other options:

https://www.irs.gov/businesses/small-businesses-self-employed/temporarily-delay-the-collection-process

Or

Offer in Compromise:

Offer in Compromise (OIC)

An Offer in Compromise (OIC) is an agreement between the taxpayer and the government that settles a tax liability for payment of less than the full amount owed. If you received a letter notifying you that your offer was rejected, you have 30 days from the date on the letter to request an appeal of the decision.

For more information, refer to:

Appealing Your Rejected Offer in Compromise (OIC) Form 656-B, Offer in Compromise

Can the VA help you with this? Or your local "Legal Aid" clinic?

I have applied for the legal aid place and going to reach out to the VA as soon as I get off this call with the IRS.

If there is no taxable income there is no need to file - Social Security under a certain threshold for example. Retirements can be taxable, but if it is very low income level you might even get a tax credit. Disability retirements you would have to check.

Ignoring them is not an option. With no input they will assess what they think you owe based on what they have. It takes them forever to assess and by the time they send you the notice you could be in the hole for thousands in interest and penalties for only owing a couple hundred of dollars in original tax debt.

I know that tax revolts are making the rounds again. Every so many years this movement gains traction again and people don't file. They have all the power and we don't - so until the IRS is abolished, anyone that doesn't play by their rules gets screwed. It sounds like you need to file the returns for the years in question and hope you didn't actually owe anything beyond a penalty for non filling. Otherwise you could continue to ride it out as long as there is nothing for them to levy. I think they have 3 years to assess a no file return from the date the tax was due. If they do not assess in 3 years, which it sounds like that is what they did, it is dead in the water. After they assess they have 10 years to collect from the assessment date. Once the 10 years is up they have to drop the collections. That is a long time to try and outrun them. It used to be 6 years for collection but they increased it because there were too many people trying to outrun them. You could also negotiate if you are in a hardship situation and can't pay it.

So find out where you stand and decide what to do from there. If all you get as far as income is disability or social security it should be easy. If you have a more complicated return that needs to be itemized, now you are in some difficulty. All the tax forms are available online for the tax years in question. I would start there. If you are low income enough you may even be due a earned income credit that would offset the late filling penalty. You could break even or owe very little. Good luck.

Make an appointment at a local office, and go for "uncollectable" status.

permalink save report block reply
▲ 1 ▼
– TrumpTrainCommando [S] 1 point 2 years ago +1 / -0

Can you explain more this "uncollectable" status?

permalink parent save report block reply
▲ 1 ▼
– Bloggerchick 1 point 2 years ago +1 / -0

Explain and document why you can't pay them, and ask for that status. Make an early appointment and show up for it prepared. They'll still say you owe that money, and they'll add penalties and interest. You'll get notices about the money you owe, but they won't move to collect it. If that status goes on for ten years...the debt goes away.

You can negotiate with them. Get them to remove interest and penalties while taking a lesser amount. Good to be poor when working out the deal.

permalink parent save report block reply
▲ 2 ▼
– HOSEQ 2 points 2 years ago +2 / -0

The Kicker on that is that now they're asking for something like Double what the Taxes were before, so IF he can get all of those Years Averaged out, the IRS has a very good chance of OWING him thousands....

The Problem with this is that he needs a CPA and a Lawyer to get this done in that manner....

The First step is to file a Massive Extension, for as long as they'll allow him so he can ""Prepare"" his paperwork and Files....

permalink parent save report block reply
▲ 2 ▼
– TrappedInBlueState 2 points 2 years ago +2 / -0

Can always see if you can settle it with them. Write them a certified letter. Offer 10 cents on the dollar. So $1-1.5k. Paid out at whatever minimum amount you can afford per month, yearly, etc. or you can call them and speak to someone about it. The person on the other end typically has authority to authorize something like that. Warning you'll sit there on hold forever so make sure you have time. This is what a tax lawyer would do for you.

That is unless you want to try and go the sovereign citizen route.

Good luck. Unfortunately, unless you are homeless, there isn't much you can do. The best defense is to be homeless, and own nothing. Then you have nothing to lose. Other than that you are over a barrel.

You're bound to the Federal reserve with the issuance of a social security number. You have to pay them unfortunately. The only way to buck the IRS is to do it in mass numbers, which will be very hard to organize. I'm disabled too but I know for a fact it's a lot easier to keep them off your back doing the best you can. I would just seek out assistance with a tax specialist/attorney. See if you can get a free consult, and tell them everything you can.

Sounds like one of the new agents hired to go after billionaires and all of their $600 transactions are coming after you. Maybe calmly explain that you love Biden with all your heart and that you're not an evil billionaire hiding wealth in $600 transactions, and they'll go easy on you.

Otherwise, either pay up or get a lawyer.

This, by the way, is exactly what Tim Pool said these agents are for. Squeezing the little guy who can't tie up IRS lawyers in court. The IRS knows that it can just send everyone making under $120K a letter saying "you owe $100" and they'll pay up. After all, are you going to hire a lawyer to fight over $100?

Well I read through your comments and it seems like you didn’t file your taxes for a specific year. so file your taxes for that year. if you had filed your taxes for that year, they would not have contacted you.

Yes the IRS sucks, and yes, having to do this paperwork sucks. I totally agree with you.

I do my daughter’s taxes, and one year I screwed up and they came back and I had to redo everything. It was a nightmare, but it’s over with now. And yes, it was a pain in the ass.

I hope everything works out for you.

OP just last year I filed 7 years worth of tax returns- took $$ out of my 401k - used freetaxusa software and filed them all & paid what I thought I owed- some years /amounts they disputed- sent me some $$ back - they also sent some money owed to the state as well. Needless to say when it all washed out they said I still owed them $1200 - I paid them $100/mth for the past year. This year I filed my taxes and the feds owed me $29 and the state $3 - how did I take it? BY CHECK IN THE MAIL-! Made those state suckers send me a check for $3! Needless to say this can be done- ask Jesus to help- then just submit it all & see what they say. Whatever they say you may owe just try to make an agreement in a monthly amount. I will say this is my 2nd rodeo with this stuff and the feds are easier to deal with than the state. Good luck & reach out again if you need further help.

I had 2 audits so far in my life. The first I ended up owing them under $10. They just waved it and sent me home.

The second one was because someone there thought I made a mistake and they changed the math on my forms. I had my copy with me and all my docs, and I showed them that someone changed it (they agreed). They owed me almost $1100. I walked out smiling and they were pissed.

Check out this channel, Freedom Law School. He helps with these kinds of issues.

He hosts live calls every week and takes call in questions. I'd do some research before giving the IRS any additional info.
