The parent who has custody for the greater amount of the year should be the one to claim the deduction. Additionally, child support paid should be deductible, child support received should be considered income and taxable.
I think it is, at least child support paid and received have to be reported on the 1040.

Disagree okie friend. the parent who pays the most should. Divorce is a civil contract and most of it is decided in negotiation. These deductions going to the parent with the most financial burden would give the parent who is not given the children a bit more negotiating leverage. If not 100 percent then at least the percentage of financial support split between the two. Better yet get rid of the income tax and set my people free.
I was a single parent of 3 and I was the only one that could claim them as dependents. Only 1 parent can claim a child as a dependent on your federal income taxes. We don't have a state income tax in Texas but maybe that's what they're referring to.
Dang guess roads can be kept up with the citizens paying state taxes. I was in Texas a week and that’s the best roads I’ve seen anywhere. Especially the extra lane for farm equipment.

From what I recall from my parenting/divorce days - claiming the kids was often put into divorce papers - I claimed mine every year, but my ex didn't pay shit and I had sole custody. Only one person can claim them so it needs to be decided up front. Merely paying child support doesn't necessarily mean you can claim the kids. The parent being paid ALSO pays for the upkeep of their kids.
That's only true if the parent who has custody actually works and isn't sitting home collecting Welfare, oh excuse me, public assistance. If you collect any public aid, you forfeit the right to claim any special financial privileges.
Lol. If only it worked that way. The ones collecting welfare either didn't give a father's name, or if the father is on disability, they give the name bc they can collect a monthly check off the disability income. Otherwise, no name and they get full benefits and daddy pays cash in support. They also farm out their kids SSN to other family members, cousins, even their older siblings. Anyone who works and pays taxes. Each family member claims 2-3 kids. Gets max EIC payment. Mom gets half. Cash. I KNOW from personal first hand observation and conversation. I've lived in some rough places. Always been friends with my neighbors.
I have 2 kids and the court told us to alternate each year for claiming on taxes. I told them they were stupid because that would trigger an audit each year, and that we would just split them and maintain consistancy. First year, the irs said I couldn't claim my kid because I was a single father. That was a two year battle and now they leave me alone.

Agree. Don’t think this was addressed for my parents when they divorced but my mom always claimed me. When I was in high school and my dad was better equipped to support me going to college my mom and stepdad agreed my dad could start claiming me instead.

My brother didn’t pay child support, they had an agreement & my dad made sure it was drawn up by an attorney. He was the only parent that could claim his son. It also had to do with his son being on his employment insurance. I don’t see how the parent getting paid child support could claim taxes on the money but I’m not an attorney or financial advisor.
Did anyone ask her to post where she heard that? It should be easy to find if he actually said that.

Only one parent can claim the child on income taxes. Taxes on the child support payment, I believe counts as income for the parent receiving it. It’s funny how crap that has been in effect for ages is coming around again as somehow Trump’s fault. The spin keeps spinning.
Judge decrees who gets the exemptions usually whoever has more custody time. Child support received is not taxable. Whoever pays does not get a break it is taxed as income off the top.
Decided by the court - if the court doesn't specify, whoever files first gets the claim, and the court might intervene later.
