I looked into these patents

Teslas patents were open sourced, with the stipulation that they be used "in good faith"

In legalese, this means anyone is allowed to use the technology as long as they are not in competition with Tesla. Any business in the same industry using them would be not "acting in good faith." Therefore any business in competition must pay to license the technology, or pay to develop their own.

So in reality, these patents are not open source. This is a PR move to keep people licking the dirt of Musk's shoes
