Not so fast, this MIGHT be a good thing. (Not a lawyer but hear me out)
Them declaring that they are a private entity outside the purview of public requirements of election laws might just decertify their entire legitimacy in participation in elections. If elections are intended to be publicly transparent and all.

For the AZ audit accuse Dominion of the vote switching tallies recorded in Michigan, then file charges against them.
After that, have them have to prove in court that they didn't do it by opening up the machines used in the audit.
If they don't, then what you accused them of is true.
The letter seems accurate, if the letter was written as a public records request. The Senate can now subpoena the same records using a different procedure and sending a subpoena to the private company.
That said, this response cleans up the blame game and points directly to the Maricopa County Board of Supervisors. The records are undeniably public records. If the MCBOS abandoned/surrendered/destroyed/lost public records, they can be criminally charged; most likely their contact with Dominion states that the records remain public, but only the MCBOS controls them. (Although the contract almost certainly allows Dominion to surrender the records under a valid subpoena).
Dominion became a public officer when it was contracted out by the Arizona AG and other elective bodies.

Well, that actually may be true as far as being subjected to a public records request from the Senate body. However, they can charge them criminally and get a subpoena and maybe civilly as well. I'm not an attorney so take this with a grain of salt. But I have read about corporations having their records subpoenaed in lawsuits before. I assume that there will be a threshold met whereby they would be able to pursue this line of inquiry via lawsuits.
