The state is in BIG trouble because the judge wants expert testimony on the videos themselves. An expert will prove they took the original and applied a blur to it, and then sent it. The meta data in the file already proves that. The problem is we want Kyle to be found innocent on all charges.This will set up a mistrial situation. The judge will need to dismiss the case with prejudice so a retrial can't happen.
