Important detail:
The United States Government is asking the court to have the US Government take the place of defendants Comey, McCabe, Strzok, Page, Clinesmith, etc because they were FBI employees at the time, i.e. government officials representing the United States Government in their official role of investigating Russia's involvement in the 2016 election.
The US Government then states, once you make us the defendant, you should remove the United States due to the Westfall Act and because the court is the wrong jurisdiction to handle a case against the United States.

TLDR: Trump can't sue Comey, McCabe, Strzok, Page or Clinesmith because they are the same as the United States Government. Trump can't sue the United States Government because he hasn't exhausted his other remedies. United States Government is looking to remove all these corrupt people because they were acting on the corrupt government's behalf.
This was filed yesterday, July 14, 2022 and the judge has not made a decision on this request by the US Gov yet that I am aware of.
There is another twist to this as well. Here is a quote from the Westfall Act, as quoted in the US Govt's motion from your link:
What can stop Trump from amending the suit and adding the Attorney General as part of the conspiracy? Garland knows they weren't acting on the govt's behalf - they were part of a conspiracy against Trump. Now, so is Garland by the simple act of trying to cover it up and get it thrown out. According to what the govt. said in their own motion only the Attorney General can use this act. If Trump can add him as part of the conspiracy there doesn't appear to be anyone else that can call that act. (I'm not a lawyer so correct me if I'm wrong).

Looks like the government admitting that all these feds followed orders and did their jobs.
Who gave the orders?
Was it "The United States of America" that gave the order?
Was there someone above these treasonous feds that acted outside their duties?
So if I'm reading the tea leaves correctly, they think the Westfall government corruption protection Act is going to save their asses?
We are not talking about conduct that was merely wrongful or negligent.
We are talking about overt criminal acts.

The US Government's position is that higher ups are "always working" and can never engage in personal activity. If the judge agrees with that it would mean that government officials can do whatever they want whenever they want, including commit felonies, and they cannot be charged personally. A plaintiff would have to take on the entire US Government to win.
If the judge allows that, we have no law for federal employees. They are free to commit any crimes they want and never be held accountable. That would be a slippery slope the size of a mountain mudslide. It would mean we have a lawless country.
Federal employees in the FBI, DOJ, CIA, etc. clearly believe this idea holds water and I personally think this explains their lawless behavior. It explains their two-tiered Justice system.
A judge that rules in favor of this is basically saying that US Government employees can do whatever they want, especially those in high positions of power.
In my opinion, this would be so catastrophic to our system of law and order that our nation would collapse under this weight.
If the judge looks at the big picture, I do not see how he could side with the government if the judge actually cares about law, order, and our nation's survival.
We shall see.

If they can't be held accountable for their treasonous because they were following orders but the "government" or "United States of America" gave the order then "government" committed the treason and should be punished.

Further, the "government" does not commit crimes...........the employees of said government do and they ALL work for the American people. Even if they commit crimes "in the name of the American people," it's still individuals committing those crimes--those who give the orders and those who implement those orders. I wonder if the people will finally object, en masse, to criminals acting, supposedly, in the name of the people?

Who is the Judge? Is he a lib or a conservative? Can the Judge ask any justices from the Supreme Court for assistance in interpreting the Westfall Act? If the judge rules the AG was acting within his capacity does this end Trump's case?
Of course, that's their position, because they are trying to get away with their crimes.
But that does not mean they are right.
No government employee has the authority to cross the line from "doing their job" to using the cover of their job to engage in criminal activity.
