my understanding from short clip I saw is that the witness says they deleted the files only after archiving them. what that means and how reliable archived data is relative to original data I have no clue
they copied it to an archive then deleted... the forensics people recovered since it was just a delete and no write zeros. this was know during the trial long ago....

They get away with it by just saying it was an accident and unintentional etc. No-one can "prove" malfeasance to the sufficient standard in a court.
