In short, it is possible that a devolved military command actually control the nukes, not Biden, but also not Trump.
The idea here would be that by implementing devolution and then walking away, Trump is no longer Potus and/or CIC, - Biden was sworn in as these - BUT significant portions of the authority of Potus and CIC are beyond Biden's control.
By analogy, let's say a CEO has 12 portfolios of responsibility (and authority) to look after. He knows that the incoming CEO is a criminal and that the switch of CEP position was criminally rigged. So before he steps out of the CEO position and hands it over, he shifts around the responsibility and authority of the CEO position - on a temporary and emergency basis - so now the CEO only controls 5 of the portfolios, and the other 7 are distributed to 7 different managers.
The new CEO position does not have authority to change that or recover the portfolios, and the 7 distributed managers have an instruction to execute their responsibility and portfolio in X manner until Y thing happens and the original authority of CEO postilion is reconstituted.
That Y might be the return of the original legit CEO, or maybe something else.
During the period between the time of devolution until the reconstitution of the original CEO authority, the original CEO is not CEO, only a civilian and an observer, although the distributed managers may be in consultation and discussion, but he is essentially free of all authority and obligation. Likewise, the incoming illegitimate CEO can ONLY do stuff within the 5 portfolios remaining to him, and they have been shaped in such a way that he cannot screw things up too much or inflict fatal damage on the company.
In this sense, the devolution of government would be like a set of 'guard rails' that hold the company on course with regards to core essential functions, but which still allow the CEO position to do some stuff and present the appearance of being in charge.
If the Nukes were one of those 'portfolios', they may very well be beyond Biden's actual reach. But Biden cannot come out and say all of that: he knows he is caught. He Knows they have everything on him, and if he spills the beans, he destroys himself.
Not sure about the EOs, but perhaps either there is something in place that forces him to renew them at the right times, or perhaps he is controlled by white hats, even while DJT is just 'a civilian' and leader working to get reelected.
The above is of course all speculative, but there is very solid foundation for this explanation and it maps on to a lot of what we see happening.
FYI, "Devolution" of government was a concept and operational option developed after WW2, to deal with a scenario where nukes were dropped on the US and most of the executive leadership, etc, were killed. The basic premise is to maintain core critical functions of government in an emergency situation until such time as the correct functioning of government can be restored and the govt reconstituted.

In fact, these are contradictory concepts, as the devolution of government down to core critical functions of government in order to preserve the nation involves devolving the Executive Authority of Potus out to a less centralized structure, and in doing such, could also involve devolving the authority of CIC out to a distributed Military authority structure.

PP is the one who mainstreamed the devolution concept, originally inspired by Thomas Wictor I think. sadly, a lot of Jon's work has been co-opted and stolen by the shameless self-promoter Derek Johnson (meaning he puts forth a lot of PP's research as Derek's own work), who also shamelessly promotes sensationalist interpretations of devolution-related content.
The cool thing is, PP developed his devolution series all based on open source intel and available documentation - Zero "inside information" - all hard researched, detailed, documented, argued logically and without failing to recognize speculation when it is merely speculation.
