Precedent set
It really does open up an interesting box of law. If an American commits a crime against a foreign invader, how does that work? (and I'm not saying this rancher committed a crime here)
Foreign invader is a criminal just by being here. I do NOT believe reparations of any kind are owed when a criminal is stopped in the act of committing another crime. Maybe the rancher should sue the family of the criminal for his actions?
Right, but lets say an American rapes an illegal. What's that legal process like?
Rape is illegal. Rape isn't "self defense" nor is it required to prevent a crime of any kind. Rapist should be charged and prosecuted.
Right, I'm just trying to highlight a potential gray area. What if someone robs an illegal?
then the robber would just be getting his money back. kek!
KEK
where's the lie?!
You don't see a big difference between a crime vs self defense? No one, regardless of status, imo, deserves to be the victim of crime. I also don't believe that criminals, nor their family, deserve compensation when that criminal is injured/killed while committing said crime.
I'm not talking about the morality of it I'm talking about the legal process.
Do we try the American in America or Mexico? The victim is a citizen of Mexico, and the perp is a citizen of America.
The victim suffered a loss at the hand of someone who belongs to a different country.
Does our legal system cover the loss of a foreigner who entered illegally and whose very presence in America is a continuing crime in itself? Yet were he a citizen it surely would.
There are probably gray areas in the law related to this, I just had never considered them before. The idea struck me so I threw it out there to see what people think. We had better get it figured out because we have a ton of illegals now.
I think it's tried where it happened. If it happened here, it's tried here. If it happened in whatever other country, it's tried there.
God bless this humble man.
Why in hell were the charges brought up at all ???
Flipping lunatic farce
THIS! ☝️
Q told us long ago... it's an upside-down world.
God Bless this man and the judge that made that ruling.
The right of human beings to self defense (and hence of just war) is laid out by Hugo Grotius in "The Law of War and Peace."
His work is a RED PILL because it is easy to digest. His logic is compelling, his language and explanations follow naturally from first principles of nature.
Men formed in societies for their mutual defense, so that each man would not have to constantly defend himself from numerous brigands. When society fails in that duty of mutual defense, the people are compelled to resume their natural rights of self-defense.
Self defense when society has abrogated its primary duty and reason for its existence, is not vigilantism, it is exercising the inherent human right of self defense of necessity.
This book is on the level of philosophy. HOW one and all are to protect themselves again without being "terrorists" is subject to debate.
GOOD NEWS that the charges against this man were dropped, but he should never have been charged and put through "the process that is the punishment."
He should be given a medal.
I nominate him for the Grotius award, for understanding his natural rights, as Grotius expressed, without having read Grotius!
Merica’ 🇺🇸
Finally a win!!!
I read that it was very likely the cartel or coyotes with him shot and killed him
The process is the punishment.
Wait, what?? But that's what the constitution says; that you can't be tried twice for the same crime.
Judges aren't supposed to follow that old rag....WTF is going on here??
What did the illegal alien do to the rancher besides trespass?
You're assuming there was evidence the rancher shot him.
Yes I was looking for the quick answer without having to research the whole story. Chalk it up to laziness if you want to. 😁
WINNING.
As I rack my 12 gauge.
Nice! Thanks for the update.
