Constitutional 'scholars' have argued that although there's a 12th and 22nd Amendment that prevent it from happening, there's a workaround.
The gist of it being that Obama wouldn't be 'elected' for a third term so it makes the 22nd Amendment inapplicable.
Therefore he's eligible to 'hold' office.
If eligible to 'hold' office it meets the criteria of the 12th Amendment.
One has to assume the drafters, of said amendments, knew the difference between 'holding' office and being 'elected' to office.
There is supposedly legal precedent for what constitutes eligibility.
SCOTUS would have to figure this one out, which is about as comforting as a waiting for a firing squad.
