DID you know, a sitting Congressperson cannot be arrested during session? I didn't until this week. Well, they are NOW on a 6 week break. (twitter.com)

There are exceptions to that rule - treason being one of them.

Correct. Exceptions are for TREASON and FELONIES.

Thought about mentioning the felonies, but I'd be willing to bet over half of them are guilty of committing felonies, but there's no one in place who will do anything about it. Most people don't care either, as long as they get free shit or they like the message. Treason might stir up most people, once they realize treason can cause them to lose all their shit.

Besides, how much better would it be to see them hang for treason vs maybe going to prison for a felony conviction and allowed out during the day and then done in a couple years?

A million times better

I was only adding that felonies "can" also get them arrested while in session

It's all good, and you were right to add that.

Sauce - https://en.wikipedia.org/wiki/Article_One_of_the_United_States_Constitution#Clause_1:_Compensation_and_legal_protection

They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.

The idea here is simple... if the executive branch can arrest a dozen members that are voting the "wrong" way then it can hold excessive power over the legislature by changing a vote. It disrupts the balance of power so they made them immune unless there is absolute proof of extreme criminal activity.

This is why Pelosi's mask mandate arrest order only applied to staff members. She literally can't have sitting members arrested. Those members are sent there by We The People and only the people who elected them get a say on whether they are allowed there etc etc. The only exception is...

https://en.wikipedia.org/wiki/Article_One_of_the_United_States_Constitution#Clause_2:_Rules

Each House may determine the Rules of its Proceedings, punish its Members for disorderly Behavior, and, with the Concurrence of two thirds, expel a member.

But to expel a member requires a 2/3rds vote. So unless a CRAP-TON of GOP members turn on MTG, Bobert, and crew then Pelosi can't do jack shit to them but whine and throw fines at them.

Of course we also can't get rid of AOC and the squad.

Wow, special rules. Well, they should not be paid for the 5 weeks off then. They get all the holidays off and then some. Plus, they get more time off in December with pay. Unfortunately, many people get holidays off, "vacation" time off, but they do not get paid.

I personally don't think they should be paid anything.... If you weren't a successful enough individual on your own outside of congress to support yourself while representing the people you serve. Then you have no business representing anyone if you can't take care of yourself...

AOC instantly comes to mind, and Bernie, and Biden, and all these parasites that have never done anything else besides government.

I don't like being told what I should do by people less successful than myself... Trump on the other hand, I always wished he would do like a 30 minute weekly fireside chat type of business education/life lesson mentorship for the country.

They only have sessions for like 3.5 Months out of every year.... The rest of their time is spend getting lobbied, raising Campaign funds, or on some sort of Vacation or hiatus, or.... They're having an INTERVAL....They have lots of those... Sometimes they'll Take a break... As if they've actually done something that was difficult, and exhausting... At other times they'll say there's been a GAP in the schedule.... no seriously, like a Two Week Gap.... Really? Someone wrote out a schedule, and simply skipped Two weeks??? How?? did fourteen days worth of pages all stick together, and they didn't notice?? Oh look, this next page is Super thick, I guess it was Made like that, like the Cover of a Book.... What the hell, I guess I'll just start writing on this next page..... dohdedohdedoh.... Sometimes they suddenly reach or find or create a Chasm.... Well, we were walking across Congress Hall, and there it was, a Large Chasm... Democrats believe it was created by Republicans, the Republicans deny it, and blame the Democrats....

Seriously, this is how the U.S. Congress has been doing things for decades... I was pointing this shit out to many Adults when I was only a young 14 Years Old....

I am ready for Trump to empty the swamp, thoroughly bleach it, and then, get back into the WH and get this country started in the right direction again by stripping all funds/properties, etc from the evil in our country and wiping everyone's debt. Giving family farmers the opportunity to get their farms back free, help out small businesses, etc with all the funds, etc from the corrupt.

Did you know a sitting Congressperson cannot be arrested during session?

Article 1 Section 6 Clause 1 of the US Constitution spells this out.

This also extends to travel to/from session as well. There was a big deal when Rand Paul was detained by the TSA, because technically that was a violation of the Constitution. But instead of pressing the issue, he deescalated it and went on his way.

There are exceptions for Treason, Felonies, and Breach of Peace.

While Congress is mostly filled with shitty people, it is still a coequal branch of government with the Executive and the Judicial branches. If the Executive branch were to be able to arrest members of Congress for minor crimes, that would be an infringement on the right of Congress to legislate. So this clause is basically saying, "You can't interfere with members of Congress doing their jobs, unless a particular member REALLY fucks up."

Our Founding Fathers were basically political geniuses.

Question—what does it say about SCOTUS justices? The new term doesn’t start until October, yes?

Could Roberts/ACB/anyone else on that bench with a book deal be fair game from February to October?

The US Constitution is not a very long document, so I encourage you to read it if you haven't already.

Article 3 Section 1 states that the Judges on the Supreme Court and the federal courts hold their office during "good behavior." This has never been challenged before, so the definition of "good behavior" hasn't been firmly established.

Any federal judge can be removed through the impeachment & conviction procedure which requires a 2/3 vote in the House and Senate respectively. Interestingly, the Chief Justice is supposed to preside over conviction proceedings in the Senate, but the Constitution doesn't specify who presides if it is the Chief Justice being impeached.

But ultimately to answer your question, the US Constitution does not provide the same special protection from arrest that Congress enjoys. We can speculate why this is the case, and I would argue that this is because the Judiciary was never supposed to be political; it is supposed to be an impartial organization that judges disputes. But Congress is extremely political and as such it'd be more likely to face arbitrary arrests than Judges.

Constitution of the United States: Article I; Section IV:

"The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.

The Congress shall assemble at least once in every Year, and such Meeting shall be on the first Monday in December, unless they shall by Law appoint a different Day."

Congress was never suppose to sit in D.C. thinking up legislation. Our reps are suppose to be in their respective State for nearly their entire term making sure the State they represent is functioning correctly. If there are grievances that have to be brought to the attention of the Federal Government, the at least once a year meeting in D.C. is the time for that.

Our politicians are living like royalty on our dime, all while not performing the tasks that they are suppose to be doing for the State they represent.

Sorry, but there are a lot of jobs out there, pull up your shirt sleeves work 2 jobs if needed to pay the rent, mortgage and put food on the table. I worked 2 jobs for 40 years to pay the bills. So call the bank, work something out and get to work. It is not the governments job to bail you out of your mortgage, or to save banks, or mismanaged auto manufacturers. Never once did I rely on the government fora handout, because it is other taxpayers footing the bill. Likewise Congress should not recess until their job is done. Just more proof we can do without them. The entire executive, judicial and legislative system needs to be revamped and down sized. The gravy train for all is over and done.

Never once did I rely on the government fora handout ...

No doubt, but you also never had the government unconstitutionally destroy your business, shut down the economy, and put you into a position that you could be out on the street. During the Covid hysteria heights, nobody was hiring. A lot of people got into a bind due to criminal actions of government employees.

Different now because businesses are getting going again and hiring (for now), but when the government employees cause the problem, it is a little different than normal "ebb and flow" of the economy.

The entire executive, judicial and legislative system needs to be revamped and down sized. The gravy train for all is over and done.

Preach it!

Actually I did know that, because that fact has been brought up during every congressional recess since October 2017. My hope is waning that we will ever see a SITTING Congress member arrested; I think the plan is to vote these people out in a massive wave, with fixed voting laws, and an awakened American public; then they’re all completely fair game.

That being said, I could also be completely fucking wrong.

Only if he or she are on their way to the house or senate for a call of the chamber. This is provided for in the Constitution so that a nefarious executive can't prevent the legislative branch from conducting business. So if a member is on the way to the airport or robbing a bank or taking a bribe he or she can be arrested.
