Kari Lake withdrew the subpoena.
The case is about Maricopa's incompetence. If they got Hobbs up on the stand she could just claim no direct oversight of Maricopa elections. They would waste their time getting her to squirm and spit out non-answers and endless denials. I think Team Kari made a strategic decision to not have her testify.
My understanding is that Lake filed a Complaint with 10 counts.
The judge threw out 8 of the 10.
Due to that, Lake's attorneys withdrew the Hobbs subpoena because her testimony was not relevant to the 2 remaining counts.
But is this reversible error by the judge?
WTF did the judge throw those 8 out?
We want to know if it was a VALID election. We don't give a fuck about WHY. If it was NOT valid, then Lake won. Let's focus on what is important.
Judge seems nice and fair, but is that only on the surface? Did he already stack the deck in a corrupt way?
I actually think the judge made the right call. He tossed 8/10 to narrow the scope of the trial and for expediency. He chose to want to rule on the most relevant and germane part of Lake's suit. The 2 issues are the machine problems leading to voter disenfranchisement and Maricopa not following proper chain of custody. Those would be relatively simple legal issues and easiest to adjudicate in a timely manner.
My understanding that the Lake team in order for time and substance of evidence allowed decided to let her stay hiding in the County Bathroom.
A few days ago there was something about Hobbs claiming she was sued in her official capacity, not her personal capacity, so rather than press it, the plaintiff dropped their request for Hobbs to personally testify.
I believe it was an effort to get the first election fraud case, since before 2020, underway and not delay it any further.

I think he was just using his reporter as his excuse. He was tired out himself.
All in all, he seems pretty balanced. I'm used to seeing pure snark from biased judges so this seems nicer.
I get a good feeling about this judge, which of course doesn't guarantee anything. We'll see.

I don't understand why he can't have two. They are trying to keep on a "trial track" of days that Superior Court does. This seems to be pretty important, voting rights. Who cares if it goes until Friday?

When they said, do you have any evidence that the Maricopa Board intended to mislead with their statement, I would have said yes. I have evidence. You are holding it right there. Is that not official Maricopa board letterhead? Have we not agreed it is authentic? Was it not their Intent to make that their official statement?
The evidence is in the very document they drafted and approved for public consumption. It's filled with lies and misstatements. We all have the evidence that they intended to misslead because they wrote and disbursed the document to millions of people themselves.
Unfortunately that is the standard the Judge set. They need to prove it was intentional and on a massive scale.
Which means as usual, NOTHING will be done and Status Quo is the verdict.

Judge seems to be working hard to allow plaintiff to present their case, and avoid defense an easy appealable issue.
Defense trying to throw shit against the wall and distract to meaningless red herrings, but judge seems to be threading the needle decently.
The defense attorney asked Miss Honey if she had any evidence of injection of ballots.
A great answer would have been:
"If we had proper chain of custody records, injection of ballots would be clear as day, but since we don't have those records there is way no telling how ballots additional to the 50 we know about, were injected. As such, we can only rely on eye witness testimony, video evidence, or other sources which I do not have."

So there was a 'winning' margin by Hobbs of about 20,000 votes, yet 292,000 election day Dropbox ballots have zero chain of custody? Sounds legit.

Add to the mix earlier evidence that somebody simply inserted 300,000 ballots, not from drop boxes and not from any polling locations.
Also, somebody (WHO?) ordered the county to report how many ballots had been cast (so far) WHILE the election was ongoing and BEFORE anyone was counting anything. Only one reason they would want that information: to know that 300,000 was the magic number needed.
Makes it clear what happened.

No ballot box drop off forms on election day? Were all the drop box locations on election day (exception of vote centers) Locked and Closed, did they change the name of the forms, or did they just not comply with requests? Fudge forms?
Day of election I think you can only drop off at vote centers, drop boxes are closed at that point.

I just went through a trial with a County Clerk exhibit list which did NOT have anymore an identification as to what it was, as Lake's attorney just stated. This was County generated exhibit list. It stayed non-descriptive.
However ...
It is still up to the attorney to disclose to the other party whatever evidence he will present. Of course, the defense attorney could be lying. Plaintiff attorney needs to be ready for that, since it is likely.
Sounds like plaintiff attorney sent a link to defense and said "here's my stuff." As judge pointed out, that is not disclosure. Judge is hearing all this stuff now with the ace in the hole that he can discard it all if he wants.
Judge does appear (at least) to be attempting to be fair on this issue, though.

This would be a shocking error, BUT knowing the County system (Court) as I do, it would not surprise me that the Clerk/County made a mistake which should not prejudice the Plaintiff.

Sounds like the Clerk refused to accept evidence that needed to be entered, and Plaintiff attorney was told it must be uploaded via website, which he says he could not do online.
Clerk is at fault for not accepting document. The courts have gotten lazy (because that's what corruption breeds).
But attorney still appears unprepared to argue his points.
He probably hasn't slept the last 4 days.
It is also possible that since this is the Maricopa County court system, the corruption extends into various clerk offices. It is possible that they are doing everything they can possibly do to throw wrenches into Kari's case, including being uncooperative and/or deceptive about specific procedures to make the attorneys look bad.

And to further answer the question, however misguided, is that I absolutely believe, or rather I know, that everyone in those positions has a bias. Anyone that's taken a 1st level psych course knows that is something humans have. A bias. Many are honorable as they work hard to not let their political biases interfere with their commitment to the constitution and the law of our land. Unfortunately it only takes a few to fuck up the whole enterprise. I don't think any of that is controversial really anywhere.

The Maricopa County part of the courts certainly. I get a good feeling about this judge, but he stated that the court system they are in is a hybrid between the Maricopa County system and another system (I don't remember the name he said). Things apparently are entered into each system differently, and it doesn't sound like the two systems communicate well with each other. So you have to submit things to both systems separately, and I am not sure that Kari's attorney assistants were fully aware of that. They probably submitted to one system and thought that was all that was necessary. Anyway, that was my takeaway from the earlier exchange where the attorney claimed a document was submitted but the judge couldn't find it in the system. I could be misunderstanding the whole thing.
County Clerk's office received documents which then once filed/uploaded into the County's system, go to the County Court system. It can take 10 or more days from the time of filing (getting that stamp from the Clerk's office) to the document entering the Court. Why the delay's now that almost everything that they can do electronically, I have no idea. The usual excuses are given. Not enough personel, holidays, vacations, ......
This is an area where I see a lot of room for biased clerks to play games since this was less than a week from filing to trial.
