Don't get me wrong - I'm a HUGE Linux and open source advocate, and this is better than nothing. But -
Open Source means nothing in this instance. In fact it could inadvertently hurt us by making it seem the machine code is perfect. At least until it is updated on election eve or election night. Just like AZ did last time.
I agree with u/winn. Ban all voting machines and go paper ballots only, with no mail-in ballots except for military overseas or at a duty station more than 50 miles from their home.

Why would the Legislature sue? If this is what the Legislature agreed to the Secretary of State must follow or there is no way to determine the popular will.
A popular vote is not required. The Legislature may seek to know the popular will but they are not required to. They set the rules on how to determine the popular will. If the rules cannot be followed the popular will cannot be determined. There is nothing to sue about. If the popular will cannot be determined the legislature votes for their states EC votes for president.
State legislatures have absolute power over Federal elections in their states. Courts have no business even being involved
Only if the executive branch doesn't comply, they will have to file a lawsuit. To me, the legislature voting on this is a slam dunk. However, the legislature doesn't have police powers either that I am aware of. So, who enforces it? Can the legislature deputize for warrants of arrest. Or does the legislature file a lawsuit with the court to getting a ruling?
There is nothing for the legislature to enforce. The legislature determines how their state Electoral College votes are determined. As of right now all 50 states use a popular vote. There is no requirement to use a popular vote in the constitution.
Article 2 section 1 clearly states... Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.
The constitution says nothing about a popular vote.
The AZ legislature determined that certain voting machines are banned. There is nothing for a court to debate. If anyone attempts to block what the legislature wants the legislature just declares the vote null of void and the legislature votes for president.
According to the constitution the executive branch and the judicial branch in the states have nothing to do with the Federal Elections. That does not mean they won't try.

Agreed. The role of the legislature is clearly spelled out in the Constitution regarding the Electoral College. I also agree that it is the legislature's role to determine whether certain voting machines are banned. However, the entrenched democrats and RINOs are going to disagree and will ignore the legislative ruling. Then what? There must be a remedy. This typically involves the courts.

Federal law MUST follow the constitution. That law falls short by restricting the state legislatures from their constitution duties.
We all agree with you.. IMHO most Americans too. Why this isn't clear to the rest is, in my view, due to their opposition and hatred of the Constitution. The enemy is already within the gate and sit in the highest seats of power.

The Governor is executive branch. The legislatures have full authority to determine how elections are run. The governor doesnt have a say.
It's been said in this thread, but I'm gonna say it again. The real win will be to ban electronic voting, PERIOD. Paper ballots for the win. Smart bad people can figure things out.

Oh also, for foreign election machines. That still means that Machine will still be counting our votes. Even if they’re made for in America, they can still be hacked.
