This is the interesting part of the article:

In defending NARA, the Justice Department argued that NARA doesn’t have “a duty to engage in a never-ending search for potential presidential records” that weren’t provided to NARA by the president at the end of his term. Nor, the department asserted, does the Presidential Records Act require NARA to appropriate potential presidential records forcibly. The government’s position was that Congress had decided that the president and the president alone decides what is a presidential record and what isn’t. He may take with him whatever records he chooses at the end of his term.

It actually goes deeper than his merely having the "authority".

He has the absolute OBLIGATORY DUTY to refuse to knowingly certify election fraud—even if he doesn't do it on TV as part of a treasonous coup d'etat. To suggest that he must knowingly rubber-stamp election fraud, the overthrow of the presidency of the United States, is malevolent disinformation of the highest order.

Pence is a liar, a snake, a pedo faggot traitor who can never be trusted. The Silver Fuck.

I'm still on the fence about Pence because I understand that Dems/Biden being allowed to steal the election was the main, essential part of the WH plan that had to happen.

So with that being said, either Pence did what he did to allow the WH plan to succeed, OR, he wasn't on our side and thought he was being clever helping the Dems secure the fraudulent election. Which of those two scenarios is what happened is something none of know for certain; we can only speculate.

NARA are clerks. I bristle at them being called librarians. Their claims are the equivalent of the guy at the storage rental facility when you bring in two boxes to store and they say "where's the rest of your stuff?" Zero authority, anyone with brains understands that.

There has never been any serious controversy about these things.

The President is the CHIEF EXECUTIVE.

Everyone in the Executive Branch WORKS FOR HIM.

He chooses to delegate portions of his authority to various agencies to carry out HIS ORDERS due to the sheer volume of work he is responsible for.

If there is ever any controversy about what is to be done - HE WINS.

Harry Truman kept a plaque on his desk saying: "The Buck Stops Here."

That is the legal and constitutional FACT.

It's a weird phrase. Because there's lot of ways to introduce evidence legally.

If you had specific evidence of a crime, you could call the police/DOJ/attorney general.

You don't have to get indicted to introduce evidence.

Here is the Trump Card in all of this:

US Constitution, Article 2, Section 1:

The executive Power shall be vested in a President of the United States of America.

That means ALL of the power of the Executive Branch of the federal government is in the office of President.

EVERYTHING else within the Executive Branch is under that authority.

Congress has NO AUTHORITY to pass ANY legislation that dictates what the President's powers are.

They can only impeach and remove from office. They have NO OTHER AUTHORITY.

  1. The case wasn't lost. It was dismissed.

  1. The tapes were not considered presidential records. Judicial Watch wanted access to the tapes through a FOIA request.

NARA said

the tapes are personal records, as defined in section 2201(3) of the PRA.

And because of that we can't give you these through a FOIA request becomes NARA never had them.

Judicial Watch wanted to appeal this. They wanted NARA to change their ruling and declare the tapes presidential records and not personal records. Then go out and grab the tapes, which NARA was never in possession of.

Again the Archivist said

For these reasons, I am of the opinion that the audio tapes created by Taylor Branch are personal records of President Clinton as defined by the PRA.

  1. Judicial Watch claimed this

A. was an abuse of power and B. caused injury to Judicial Watch

  1. Judicial Watch then sued under this law. https://www.law.cornell.edu/uscode/text/5/701 I'm no lawyer, but this seems a big stretch.

It would be like a liberal group finding out Trump kept a diary and then going and trying to FOIA it and then sued NARA to go get it. I don't think this is analogous to Trump's case.
