Railroads have liability to conduct their business to the appropriate standard of care. Whether they did that or not depends on the circumstances. If, as I have seen elsewhere, they were alerted by some kind of fire or heat sensor but instructed to continue on another 20 miles until implosion, and that ends up the proximate cause of the derailing, they will for sure be liable.
If they were not privy to the type of cargo they were hauling, that can impact whether or not they are liable - assuming it changes the standard of care. Ohio is a comparative negligence state. Which means you are liable for the % of harm a jury assigns to you as fault. You can bet that plaintiffs lawyers will sue anyone that touched that train and let them fight it out. Railroad will likely seek contribution from other possible tortfeasors.

This case keeps getting kicked down the road. Now we are looking at a late spring or early summer trial date in 2024. And that is at the moment. Trial was originally scheduled for March 2022.

No matter what happens, there are gonna be a ton of appeals. This case should not be in the DC circuit. Neither party are DC residents, and neither the acts/omissions allegedly giving rise to the claim for relief substantially occurred in DC. This was venue shopping at its finest.

One of the more perplexing things I learned when doing a deep dive here was about how we have created a huge problem with chickens via antibiotics. The particular person you describe is still a human being. We are who we are. Most people are not leaders, they are followers. You can’t harbor hate or animosity to someone for being who God made them to be. We need followers just like we need leaders. Short version of a long story, I sometimes find myself going 3-4 days in a row with never leaving my house. Winter sucks and I also do not need to go to my office ever anymore. Though I do when its impossible to work at home. So I don’t hardly feel like this during those periods. But if I spend more than a straight to the point grocery store trip in public I feel awful for at least a day or 2 and sometimes longer.

I don’t think we can answer that based on these trials. The jury pool is substantially larger in the eastern district, with some counties that are solid red. In comparison to the DC pool which is like 95% blue. I don’t think VA is any more or less corrupt than the rest of the federal districts.
I actually don’t think either Sussman nor Danchenko were guilty of the crime they were charged with - lying to the fbi. Don’t get me wrong, they certainly lied. But the required elements of the crime were not met.
Government must prove beyond a reasonable doubt (1) the defendant made a knowingly false statement; and (2) that false statement had a material effect on the investigation. They can’t ever meet element (2) in either of these cases. Because the FBI was moving forward with this bullshit narrative anyways. And the FBI/DOJ themselves lied to the low/mid tier agents involved in investigating it as to the source of these allegations.
Sussman & Danchenko were merely the vehicles by which the corrupt bureau was going to launch this investigation. If for some reason Sussman & Danchenko croaked before delivering this stuff, they would have simply recruited some others to do the same. This “Russia collusion” bullshit was happening regardless of what either of those 2 said to the FBI. Hence, they are not guilty because there was no material effect on the investigation from their lies.
The FBI is trying to create that narrative, and with the help of some co conspirators in the senate. The NYT hit piece is insane propaganda and cope. Something for sure has to be happening. Otherwise, why do anything at all?
