You know who could have determined the classification status? Trump. Because he had Original Classification Authority. When he was leaving presidency, he could have waived his hands over it and blessed it as all unclassified no matter how sensitive or serious the documents are.
This is in contrast to Clinton who did not have original classification authority.
Whether you agree with the president or not having ultimate decision authority of what is or isn't classified, it is a power that the president has legally.
I also guarantee you that the locations which he is storing them "45 Office" are 100% going to be safeguarded to being a proper storage location for the documents (unlike Hillary's basement extremely vulnerable server).

Your question is completely irrelevant. These docs were declassified simply by PRESIDENT Trumps removing them from the White House.
This is the word that needs to go viral. The President is the ultimate authority on declassification and all declassification stems solely through the President. No other governmental authority, even an act of Congress, can diminish this power or alter the effects. By simply removing these docs from the White House to Mar a Lago, they are defacto declassified. Nothing else must be done. Therefore, there is absolutely no basis for the warrant nor the charges brought against him..

As I understand it after reading the PRA 1978 (Presidential Records Act) along with the Barry Obama's EO13489 (2009) a sitting President can simply declassify anything at any time with a wave of the hand and by saying so. Which would make it incredibly difficult to say that the documents at MAL were not declassified!
Then we get into the redactions which is usually where it all falls down and takes the time. But people also need to start asking where are the 30 million plus documents from Obama's time destroying the country and why haven't they been digitised yet as promised.

I'm confused. I thought when you approached the building saying you have a search warrant you have to give it to that person along with list of what you are looking for. From what I see it appears the warrant was made after the raid and since Trump wasnt there he cant be charged because he was not handed the documents. As for the list of items they were looking for, why did they go through Melania's clothes? Who were those agents? Could they have stolen her designer clothes, bags and shoes for their wives worth thousands if not millions of dollars?
