The victims should realize that they should not take legal advice from a government notice. Their remedy is criminal charges against the FBI for the federal crime stealing property across state lines. The FBI will not inform the victims about this.

To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress;

Congress has no obligation to tell you whether they are legislating for the Territories or the Union.
It all comes down to intent. If the driver knew it was Gage and it was premeditated, then that is criminal. If it was simply dark and he didn't see Gage, then it was an accident. Criminal law gives a lot of weight to intent.
