I slightly disagree with this. Government should try to encourage behavior that benefits the state while discouraging behavior that is detrimental to it.

Heterosexual marriage benefits the state in that it encourages stability. Hetero married couples have children and that preserves promotes economic and cultural stability. So I am fine with the government encouraging hetero marriage via things like child tax credits, being able to file joint tax returns, declaring dependents, etc.

Although, considering how prevalent divorce is now, I am now questioning whether this is still true.

  • Lawrence v. Texas - made it so that no laws could be made concerning gay sex
