I've started reading more on this as rumors spin up that blanket pardons may be issued for Fauci, Cheney, Schiff, etc. While it will raise the very obvious question "if they didn't do anything wrong, why are they getting pardons?" The left's response will of course, be "because Trump is going to persecute them as revenge."
That's all fine and good, maybe they will argue that the blanket pardon will absolve them of any treason allegations.
Not so fast....
I'm not a lawyer by any stretch, so I turned to ChatGPT for a summary to the query: "Does a blanket presidential pardon cover treason?". Here is the response:
A blanket presidential pardon, granted by the U.S. President, can potentially cover treason, but there are limitations and nuances to consider.
Under the U.S. Constitution, Article II, Section 2 grants the President the power to "grant reprieves and pardons for offenses against the United States, except in cases of impeachment." This means the President can issue a pardon for treason, but there are important conditions:
Treason Definition: Treason is defined in the Constitution (Article III, Section 3) as levying war against the United States or aiding its enemies. A person convicted of treason could be pardoned for their crimes.
Impeachment Exception: The Constitution specifically excludes pardons in cases of impeachment. If a person is impeached by Congress and convicted, they cannot be pardoned for that.
Scope: A "blanket" pardon could, in theory, cover treason, but it would need to be specific about the offenses being pardoned. A blanket pardon might be issued for a class of offenses (e.g., federal crimes), but would not protect someone who was impeached or convicted of a crime outside the President's pardon authority.
In practice, a presidential pardon for treason is rare and would likely be highly controversial due to the severity of the offense and its political implications. However, the pardon power is broad enough to cover it under constitutional provisions.
The way I interpret this, is that SCOTUS would probably determine that a Presidential pardon would not cover a charge of treason as it was not spelled out in a blanket pardon.
I also checked and found that UCMJ is considered Federal law, so therefore a pardon could include any violation of military law or law of war. Now, if they are determined to be enemy combatants, I think a lot of the veil will be pierced. Of course, fraud vitiates everything.
Nice dig! Will be interesting what they'll try to do or actually do. They may spin it as "unwarranted overzealous prosecution protection' or who knows. My thought is that they will try everything and anything to protect themselves and their players.
I'm confident Trump has a plan for that.
I’m of the belief that the 2020 election will be determined to be fraud officially. And since fraud vitiates everything, Biden wasn’t president, and his pardons are bupkiss, and that cunt Kuntanji Brown-Jackoff isn’t on the Supreme Court.
Bingo.
Limitations: The presidential pardon only applies to federal offenses. State crimes are beyond the President’s pardon power. As explicitly stated in the Constitution, the President’s pardon power does not extend to cases of impeachment. If a president who won an election through proven fraudulent means were to pardon individuals involved in the election fraud, several complex legal and political scenarios could unfold: Legal Validity of Pardons: If the president’s election is later invalidated due to fraud, there’s a significant question regarding the legal standing of any actions taken, including pardons. The doctrine that “fraud vitiates all” might apply, suggesting that acts stemming from a fraudulent basis could be considered void. However, this would likely be a matter for judicial interpretation. The Constitution does not explicitly address the scenario where a president, elected under fraudulent conditions, uses the pardon power. The Supreme Court might need to rule on whether such pardons are valid, especially if the presidency itself is deemed illegitimate. , if a president were proven to have cheated in an election to win, any pardons issued might face legal challenges, potentially being deemed void or invalid.
Brunson?
I hope his plan is to show the 2020 election was stolen making everything Biden did null and void.
Make it make sense. The same assholes that screamed “no ones above the law”, impeached Trump twice and threw every legal fork at him they could get their hands on for the past 4 years now wants a security blanket of immunity because they claim he’ll come for revenge? Wow just wow. It’s so blatant you have to be blind not to see the absurdity and hypocrisy. And yet the media is still able to spin it to the normies as “totally fine” because “orange man is bad” and will put poor Pelosi and shitface in the slammer. What happened to their belief in our justice system? Or does that only count when they are in control? Yeah it’s funny how they act once the tables are turned. But not to worry. NCSWIC and Q said we will love how this movie ends.🍿
What happens when it is proven Joe Biden didn't win the 2020 election? Hmmm......
Everyone knows he stole it.
True, but soon many, many more will admit it.
I'm wondering what the military justice people have to say about this. When an American citizen becomes an enemy combatant or otherwise aligns him/herself with a hostile foreign power actively waging war (kinetic or otherwise) against the United States, what is the military's obligation regarding protecting America from such enemie?
Not sure if this covers your question, but Obama ordered a drone strike to kill an American citizen that was never convicted of a crime.
I remember that . . . and I don't know if that DOES answer my question, as you probably figured, since it was Obummer droning an American . . . could be legal, might be not.
if biden starts issuing blanket pardons to everyone, then we, as patriots, should start refering to democrats as the party of benedict arnold...
Anyone accepting a pardon would by that very act be admitting guilt. We can take that route if they wish but no matter which road they choose it will end at Gitmo for them.
Can a blanket pardon stop a military tribunal?
Who runs the military... Yes.
Well done blacksmith! Your digging has answered questions I've wondered about as well. 👏
I will revisit the movie "Minority Report" if potatus blanket pardons anybody else.
Remember, the fact that they are pardoned, does not mean they can't be tried for their crimes. It just means they won't be sentenced.
So even if pardoned, they can still be tried, found guilty, and humiliated in the court of public opinion. And the advantage is they can't invoke the 5th Amendment. And if they lie, they've committed perjury which would not be covered under their pardon. If they refuse to answer anyway, they are in contempt of court and can be imprisoned.
It may be that this is the trap that forces them into turning on each other and revealing who is pulling their strings.
This hasn't been tested yet. It is heading for court as we speak though.
I think now the hammer has to drop that the election was stolen in 2020, voiding all of these pardons. The diamonds must be returned.
I heard recently that Hunter being pardoned means he can be compelled to testify. That if he tried to pull a stunt like holding a press conference outside of Congress again he can be thrown in jail.
Also need to remember that a pardon doesn’t cover international crimes. Thinking of Burisma, Fauci building bioweapons in China, etc.
Hunter Biden is doomed. Joe Biden already executed.
🍿 🐸
I haven't seen evidence proving Joe Biden's execution. Does any exist?
If a pardon is given by the "President", then can the next President rescind the pardon (like an executive order)?
No. The pardon forgives the crimes. Now - if the POTUS was found to be illegitimate, it would be a VERY sticky situation. Removing the pardons and trying the people could be double jeopardy. SCOTUS would have to get involved because it would be a constitutional crisis.
The Law of War Manual must include remedy for this eventuallity! How can a treasonous president pardon others for treason?
But what if the president who did the pardoning was guilty of treason?
He cant just give out blanket pardons to everyone. If there is a pardon it should first be for a charge already filed or an indictment already delivered.
According to SCOTUS the only requirement is that the crime has been committed. It can be pardoned before criminal proceedings. The question is whether each specific crime would have to be named in the pardon or if they are allowed to be pardoned for any and all unspecified crimes. I’m thinking this will end back at SCOTUS if more of these blankets starts getting passed out to cabal members and their puppets
Yeah - he can. The only restriction he faces is pardoning an impeachment. There are NO other restrictions in the constitution on pardon powers.
A presidential pardon for some of the most egregious crimes known to humanity?
Good info, but the way it reads I don’t think the preemptive part is gonna hold up. How can you pardon something/ crime that hasn’t even happened according to them?
Ford already set the precedent.
If you want to, could you please ask if people not charged with any crime can be pardoned.
I think their plan with this malarkey is to take our "Innocent Until Proven Guilty" protection away from us.
I heard about this and had to go for a long walk. I'm sure the dog was wondering what all the steam coming out of my ears was about, but she appreciated the long walk.
After all the shenanigans in the courts over the last few years, I don't have a lot of faith in our civilian courts anymore. I feel like they are a crapshoot as to whether the public will see any real justice out of it. I hope there is a way to rid our country of all these fuckwit Soros DAs and judges that have corrupted our judicial system.
I'd like to see all these politicians get seats at public military tribunals to sort this crap out. I can't see them playing these kinds of games that we are seeing in the civilian courts.
You realize none of it matters right? He is an illegitimate president with no authority. Everything he does can be reversed because he has no legal authority to do anything but take a dump.
Maybe they'll all start dying suddenly anyway.
Nicely done./
On the face of it, it's comical, and completely illogical.
I guess we're doing Minority Report style pardons now?
Any person who champions this just outed themselves as commie rats, and quite possibly worse, dumb as shit.
“Rules for thee, not for me” taken to a new level of vomitous disgust 🤮
