If you celebrate a guy you don't like getting arrested for exercising his rights then the next should fall easy.

This guy is an unlikeable prick but no law - NO LAW - shall be made that infringes upon our God-given rights! The Constitution is there to tell elected "officials" what they can and can't do. We the people are free to do what we want within our rights.

I agree with President Trump's sentiment but he literally violated the Constitution and his new "law" is unenforceable.

👍 the actual wording… does NOT criminalize burning the American flag, and does NOT infringe on freedom of speech.

It criminalizes flag burning only when it’s intended to incite a riot. the arresting officers and Federal DA will charge the future flag burner with inciting a riot.

Basically semantics, the flag burner goes to Federal Jail for 1 year, because he incited a potential riot.

The problem with government is that NOTHING is ever temporary and that even bad precedent is promulgated for eternity. Don't give a shit about the 1st amendment in this specific act....Noone burns their mother countries flag. Anywhere else, You do so at the risk of being at the receiving end of instant street justice or being arrested and beaten up in jail or deported and your citizenship or visa revoked. Why does usa tolerate this, it must be drilled into every person head that the flag represents your country of which you are a citizen off and for which many have sacrificed and died for. No he doesn't. In the remarks when he signed the EO, there's a lot more nuance to the order than how it's being presented.

The coverage might be a case of drawing attention to it, so that people who investigate will see it's actually a common sense and perfectly constitutional action, whereas the media will leap on it to describe him as Hitler again, only to be proven wrong.

We'll find out when the order is published, but it seems like the order requires greater attention from the DOJ for any criminal activity which involves burning a flag, and specifically investigating whether it can be prosecuted as incitement to riot. This guy shown above should be fine.

It's symbolism. Like speech, it represents an idea to communicate thoughts. Speech is auditory symbolism of ideas. Sign language is symbolism too and I'm sure you understand that a person using sign language is engaging in speech.
Lots of things are dangerous, including guns, kitchen knives, etc. they can be used without threatening harm to anyone. Sure, if I burn a flag and throw it on you while you're filling your gas tank, I should go to jail. If I burn a flag (not that I would) in the middle of a paved open area, it could be done without endangering anyone.
Should hating be a crime? Should hating what the flag stands for be a crime? Perhaps you and I value the great things that the flag stands for, but another person might see the flag as standing for all the evil crap that was done by the evil elements of the US government, such as CIA assassinations, Waco & Ruby Ridge, military industrial complex forever wars. Do you only value freedom of people with the same ideas as you? That's not actually freedom.

I totally get it , I’ll be honest I was somewhat one of those flag haters years ago because I hated the goverment so much , I wss as not so much anti American per say but I was definitely anti goverment . I hated everything they were doing . I was much younger and it was after Vietnam and some of the situations you mentioned Cia , Ruby Ridge etc . I’ve understood and matured much since. Now the gov I hated kind of flipped the script and have brainwashed the people in this country to destroy it , and each other ! Pretty crazy, I still am agaisnt burning the flag as I believe we need to make a stand for America and stick together as a nation not hate it and allow demons like those in Dearborn Michigan turn her into death and destruction from within ! I knew someone who was arrested on a misdemeanor arson charge for symbolically burning a note with things she didn't like about herself on it on a public sidewalk.

I don't see how this is any better. It isn't like he is doing this on his own property in a properly set up fire pit.

Should I be allowed to block the exit to a neighborhood with a giant tire fire for free "speech"? What about protest the fees to camp in a national forest by burning a dollar bill on the ground during a drought or Santa Anna winds there?

Fires aren't speech or the press, they are destructive actions and potentially common law(pre statutory) felonies that the courts have been perfectly will to let the government regulate for everything other than flags.

It's not a symbol though. It's actually a fire. Not a symbol of a fire.

But, if we say it is symbolic, what is it symbolic of? It's symbolic of the destruction of the country. Flag burning says, "This country should be destroyed". Is subversion protected by free speech? Can I say, "This country should be destroyed by fire." and agitate for it? I don't know.

This is why the perverts get angry when their flags or paintings are messed with. They understand what's happening better than we do.

He could throw it on the ground, burn it on private property, cut it to shreds and spit on it and he would not have been arrested. He lit a dangerous fire on a public sidewalk, so he goes to jail.
