The U.S. president has no legal power to fire Congress or the Senate, no matter how long a shutdown lasts.
Here’s why:
Separation of powers: The Constitution keeps Congress, the President, and the Supreme Court separate. Each branch checks the others, so no one branch can dissolve another.
Elected positions: Members of Congress are elected by the people of their states and districts. They can only be removed through expulsion by their own chamber (2/3 vote), criminal conviction, or election defeat.
No “dereliction” clause: There is no constitutional mechanism that lets the President declare Congress “derelict” and disband it. Even in war or emergency, that power doesn’t exist.
Historical note: Only monarchs and dictators have had that kind of authority. The American system was designed specifically to prevent it.
So even if the government stayed shut down for months, the President’s only options would be to negotiate, use executive actions where legal, or call Congress back into session — not fire them or call new elections.
